A Initial Study Of Justice Theory Model On The Background Of Building Harmonious Society

At present,goes with market Structural adjustment,emerging the structure of various benefits, homogeneous culture splits immensely, several problems need to be faced in China, as the heavy pressure of employment,the increasing unemployed population,gap between rich and poor is widening, forces of secession are rampant. China Communist Party who faces this new situation and new problems,puts forward governing ideas of building a harmonious socialist society at the Party's national congress,in order to establish a democratic,lawful, equal,sincere,vigorous,and harmonious society. At this stage,the issue of China's mainly fundamental discordant contradiction is the grossly unfair distribution of benefits . Not long ago,Premier Wen Jiabao said:" Promote social equity and justice,especially, let justice become the primary value system in socialist society ." It tells us that the most fundamental and soul characteristic of harmonious society is social equity and justice, we need the justice political rules as a support to solve the above disharmony problems. This dissertation,in order to build a theory model of just rules in political system is initially based on this historical background,and expects to make theoretical contributions to build a harmonious socialist society. In this dissertation,by using behavior contacts which from the beginning of human society and which is the core act exchange,take the analysis of the multi-cultural of the historical background as a reference, it shows social trends through the public consultation procedure to reach a consensus (self-identity) society, justice theory must match the trend to reach consensus rules,indicates clearly,the task of social justice at this stage is everyone reaches consensus (self-identity) through equal and effective participation of the public consultation procedure,then show that the most important fundamental consensus in modern democratic society should only be the Constitution,and from the authority,institutiohal and legitimacy three dimension of Constitution to analyze why Constitution become the most important fundamental consensus in modern democratic society,as well as what's the content of constitutional consensus (self-identity), which is the basis of analyzing the freedom of reach constitutional consensus (self-identity) as well as restrictions on the freedom. Given the important function on restrictions on freedom of the public consultation procedure,separate it to a special part to study,the article mainly researches on the characteristics of public consultation procedure and focus on it to carry out analysing the elements of the public consultation procedure. Finally, combine with China's recent several issues with point of view of this dissertation,in order to test the effective point of view of this dissertation,and give some suggestions about Chinese constitutionalism.
