Discussing Zhan Jian's Neoteric Nomocracy View And Proctice

In neoteric history, under the impact of Occident culture, intelligentsia accepted to new thing and deserted old thing .traditional feudal intelligentsia group approached to contabescence, adversely, newly occurring intelligentsia group of which Zhang is one gradually developed. His enterprises starting point is relying on industry to save our country,but in the progress in founding enterprises ,he discovered that feudal political and lawful system of Qing Dynasty was very outdated and neoteric political and lawful system was advanced ,so ,gradually, his nomocracy view changed. The main content of Zhang'nomocracy view have two sections: one is macro constitutional political view related with national political and lawful system before the founding of the Republic of China, the other one is micro exact economic law viewpoint after the founding of the Republic of China. In order to actualize his political system view he persevered in practicing hard.This thesis, by the occurring and practice of Zhang's constitutional politic view, by the analyzing neoteric economic legislation activities under the reining of constitutional political view, tries to expose that Zhang contributed to exploring the approach to law system modernization from absorbing the essence of China and Occident culture,to realize neoteric law system reformation track ,difficulties of reformation,positive significance taken by his view.
