Research Of Countermeasures On Improving The Law Enforcement Level Of Health Supervisor

Reform of Health supervision system has been enforced, that every ranks of sanitary supervision institutes in our country must have a license for dividing of monitoring and supervision, according to the requirement of health in 2000 it is a major mark in reform of sanitary supervision system. Under this background, the prelude of reform in Jilin province is all-around started. The work of health supervision is a significant component of Public Health System and it is a very important part of Legal system in China. Under circumstances of constructing the legal country and the legal government, sanitation is a vital part of governmental work: we must deal with administrative in accordance with the law and enhance the supervision level of health law enforcement. As the administration and fulfiller of health oversight functions, the public health supervisor plays the decisive role in accomplishing health supervision effectively. With the advancing of sanitary supervision system reform and the revising of health supervision, our government particularly needs a high-quality team in health supervision.In this paper, I used the qualitative, quantitative method and empirical analysis method, taking the reform of sanitary supervision system opportunity, focused on the dividing of monitoring and supervision after the reform of sanitary supervision system in Jilin province, embraced the switch of function tightly and symposium, analysis the statistics through the investigation of 19 health supervision departments in cities and counties (districts) in Jilin province. Study on the questionnaire, interviews, discussions of organize relevant personnel and retrieved the questionnaires. Data processing methods such as statistical analysis released recovery scene questionnaire will use data from Excel input and statistical analysis. The questionnaire for health supervision supervisor include following contents: the basic conditions of supervisors, personnel training (continuing education) and the level of supervision and law enforcement. First, the basic conditions of supervisors: about sex distribution, the proportion of health supervision agencies between female and male on all levels is roughly the same, male is more than female; about age distribution, most of them are 35-45 years old; in the constitution of education, most of them had secondary or advanced educational background; about the professional major, learning in regard to the prevention and clinical medicine; about the distribution of titles, most of them are intermediate grades. The differences are obvious. Second, supervision and law enforcement: in the investigation of the course of the current difficulties in law enforcement, we found that the main reason is that the insufficient funds, administrative intervention and legal awareness. The last problem is staff training and continuing education. The specific conditions on the former are better than the latter. Short and medium middle term training is the main way and the public health and the law is the major contents.The questionnaire for institutions include following contents: the survey of income, expenditure and the administrative punishments. First, the survey of income and expenditure: all levels of data in the city of health authority are obviously higher than the health authority in province and county region. But the fund on all levels of health authority is rising year by year. Second, the administrative punishments: in the survey of health administrative punishment measures, the provincial health provision has been at the lowest level. The number of affairs about health warning and be ordered to cease are higher in the country regions than other areas, other three indicators are the highest in the city health provision department.According to data analysis, finding the problems and influencing factors in the health enforcement supervision. The main problem is there was no a sound mechanism in personnel hiring. The major of supervisor is unitary. Legal concept is weak in supervisor team. The long-terms assessment and training system has not established and the overall qualities of health supervisor should be improved. The influencing factors mainly concerned with the five aspects, including the government health administrative departments, People's congress and other relative departments. In view of the above issues on how to improve health supervisors'level of enforce the law to raise the following countermeasures and suggestions: the government should change the existing management structure and carry out a top-down vertical management, and establish a special mechanism of material security; legislation should be clearly defines the duty of health supervisor departments and gradually perfect the legislation; health administration department should strictly abide by qualified access to system, strengthen job training and exhibited a long-term mechanism for examination; health supervisors should strengthen their moral qualities, ideology and culture, set up a stronger sense of responsibility and foster lofty professional ideals and the prevailing civilized customs; others should be made to strengthen education of the manager, the higher education mode and to strengthen the coordinate of other relevant departments.
