The research of property right system in hospital industry is based on the logic of property right economic theory, it is a discussable issue about setting up the modern hospital property right system, which is suitable or not to the market system and public finance system. The 16th People's Representatives Congress Conference has clearly declared the direction of the reform of the property right system of national hospitals; the nation- owned hospitals keeping sole ownership to the property, meanwhile, are required to carry out the innovation in the reform of the property right system. Innovation is the premise in practicing the rationalization in hygienic resources distribution, also the prerequisite condition to converse the case of insufficient and unreasonable roaring cost that feature our hospital industry. However, the hospital property right reform has its obvious industrial characteristics; it is definitely different from general enterprises. Owing to the intensive knowledge and technology is the significant characteristics in this industry; human capital therefore comes to be rather special element in the property right. But, at present, two shortcomings are existing in this awareness, in other words, AAA hospitals are not conscious about starting this kind of reform, they have not considered that inspiration approaches works in the management of the human capital, which is important for property right reform; secondly, there are few theoretic discussion in significant documents, so it is vital to research and discuss the reform of hospital property right system; the property right inspiration in human capital at present, these two research and discussion yields practical meaningfulness in the enforcement of the hospital management, development of the hospital efficiency and performance, the safeguard of the hospital going on running as well.This paper founded on the economic theory of the property right, via analyzing the process of carrying out the rules of property right arrangement, revealing the fundamental conflict in the regulation arrangement of human capital, deeply exploring the approaches in inspiring human initiative, combined the investigation activities in these aspects shown in ShangHai KangAi hospital, works out some humble principles and routes for nowadays hospital reform in property right system.
