Animals are living beings with perceptual and emotional abilities,which have particularity and multiple values.The western theory of animal rights has a development history of one hundred years.The theory of animal protection has developed from the early field of philosophy and ethics to the field of law,while the discussion of animal rights in China is still in a relatively primary stage,which is bound to hinder the process of animal protection in China.To this end,we first start with the definition of the concept of animals,limit the discussion object to vertebrates that are more closely related to humans,then make a comparative analysis of radical animal rights and mild animal welfare,demonstrate that they are essentially the same,and demonstrate the necessity of legalization of animal rights around the moral basis of animal rights and the practical basis of legalization of animal rights,On this basis,this paper attempts to define the basic content of animal rights from the five internationally accepted principles of freedom,respond to the boundary of animal rights and the conflict between human use of animals and animal rights protection,and demonstrate that the legalization of animal rights is practical and feasible.Finally,based on the actual situation of animal protection in China,this paper analyzes the problems existing in legislation of our country,such as unsystematic legislation,insufficient protection,heavy utilization over supervision,emphasis on rare animals and contempt for common animals,etc.,and puts forward the principle of gradual and orderly progress,establishes the legal status of animal "special objects",establishes the animal rights agency system,formulates the basic law of animal rights in our country,and gradually builds the legal system of animal rights protection in our country.
