The Legal Regulation On Skinning Pelage From Fur-bearing Animal---From The Perspective Of Animal Welfare

With the increasing demand for fur products, the industry of fur producing becomes prosperous all around the world. However, few people aware where fur comes from. As is indicated by some statistics, at least millions of animals, whose fur is used to make fur products, are brutally killed every year. A video named "peeling fur from live animals" on Youku got substantial clicks. As followed, fur industry was criticized by the public as inhumane and cruel. This video was shot in Suning Hebei where huge number of fur products was produced every year. Because of this video, not only bad national image was taken place but also a movement named "saying no to fur products" emerged. Some international organizations and individuals abroad cracked down on China fur products, accusing China is not qualified to be a member of International Fur Organization due to its poor performance in violating animal welfare. They not only appealed Finland International Auction not selling Chinese fur coats, but also organized parade to persuaded customers not buying Chinese fur products. Then PETA made a suggestion to European Union that a law should be made to crack down Chinese fur products. It is true that Chinese fur industry has suffered a lot of setbacks in exporting, which is a huge economy loss.China is well acknowledged as a competitive country in producing, processing and exporting fur products. However, after publishing law on animal welfare standards, United States, Europe Union and some other countries in the west have restricted products from China, which has seriously damaged domestic fur industry. A lot of reasons may contribute to this awkward situation. In this paper, I will apply "the way of getting fur" to analyze the consequences caused by the notion of animal welfare. At practicing level, this thesis hopes to attract public attention, actively prompt the development of animal welfare industry as well as human society’s constant progress. In my thesis, three puzzles will be addressed and solved: how to get fur, how to guarantee animals’basic welfare, how to make sure fur products produced by Chinese meet the animal welfare standards for the requirement of fur products exportation.In the second part of this paper, I will explain the conception of animal welfare, which constructs the theoretical framework in my thesis. In the third part, I will throughly analyze the reasons and negative effects caused by shortage of animal welfare and the traditional ways of getting furs. In the fourth part, I will analyze the necessity and feasibility on improving the laws and regulations on the way of getting animal furs. The fifth part will illustrate relative laws and regulations in Hongkong, Taiwan and other countries. Also I will summarize the valuable experience for China to learn. In the sixth part, I will point out how can China gradually establishes the system of laws and regulations on getting furs according to practical situation, so that a scientific and reasonable animal welfare system will be taken shape.This thesis will analyze and summarize ways to improve our laws and regulations on getting animal furs. By comparing laws and regulations in other countries and regions, I will find out positive and negative sides of these laws and regulations. In the end of this thesis will provide corresponding suggestions, which should be able to let public realize the awareness of protecting animal welfare.
