Research On The Principles Of Forest Ecological Benefit Compensation System

Forest, as the one of the most important parts in terrestrial ecosystems, possess both ecological and economic benefits. However, unawareness of the forest ecological benefits, pursuit of its economic efficiency unduly, ecological benefits were ignored for a long time. In order to protect and maintain our forest resources and to prohibit the abuse of forest, part of the forest in our country were marked out ecological forest. But at the same time, because of the lack of effective mechanism to provide financial compensation, ecological forest owners lost economic benefits. Therefore, effective balance of interests could not be set up between protectors and beneficiaries of eco-efficiency. On that basis, China need to establish a sound mechanism of forest ecological benefit compensation, and first of all should establish the principles of ecological benefit compensation system. This paper firstly defines the forest ecological benefits compensation, followed by summarization of the status of legislation and the legal basis. Through the study of foreign legislation and practice, using the experience of other countries for reference, the paper come to a conclusion that the main principles of forest ecological benefit compensation is public-pays-principle, government-led and market-oriented principle, benefit-pays-principle.
