The biggest difference between ecological environmental damage and environmental infringement is that its damaged object is ecological environment itself(that is,the public interest of ecological environment),which excludes personal rights and property rights.Although the compensation for ecological and environmental damage is different from the liability for environmental tort,the nature of compensation for ecological and environmental damage is the same as the liability for environmental tort,which is a special type of liability for environmental tort.A lot of achievements have been made in the exploration of compensation for ecological and environmental damage in our country,but it has been proved in practice that there are still many problems in the compensation system for ecological environmental damage in our country,mainly in the following aspects: the system is not perfect,the nature of compensation is unclear,and the model of imputation principle paste,constituent elements and relief procedures are not perfect,unmatched,and so on.The purpose of constructing the compensation system of ecological environment damage is to make the compensation of ecological environment damage develop smoothly and orderly.Based on this,it is necessary to start with the overall framework,explore the content of the ecological environmental damage compensation system and clarify the general principles of the ecological environmental damage compensation system,through comparing with the theory of environmental tort liability to sort out its constituent elements.Imputation principle and compensation principle,at the same time improve the relief procedure of compensation for ecological and environmental damage.
