The Environmental Legal System In The Process Of The Ecological Civilization

Since the early 80s, our Government has put environmental protection as a basic state policy. Environmental legal system worked in environmental protection has played a very important role. However, the environment legal system started too late and had not been placed enough emphasis, as well as the environmental legal system updates too slow, it increasingly showing the aspect that could not meet the current needs of China's ecological civilization construction.In recent years, environmental problem of our country is becoming more prominent, this issue is not only a part of social development, but the overall relationship between the major practical problems. Today, the market economy is increasing maturity and the legal system is gradually improving, establish and improve the environmental legal system, manage around the rule comprehensively should be the best program to solve the current environmental problems. Particularly, after President Hu Jintao made the report in the Seventeenth Party Congress that realize the construction of ecological civilization fully, improve the construction of ecological civilization is urgent.As early as 1999, Prime Minister Wen Jiabao advanced a scientific thesis that"21 century will be the Times of Ecological Civilization". Five years ago, the theory of persisting in sustainable development, promoting harmony between human and nature and promoting production development,rich life and ecological environment is definedto be the one of the objectives of the"Well-off society construction". Nowadays, the theory of ecological civilization not only enriches the Marxist theory of ecological civilization but also sublimate the objective in theory. At the same time, the theory of ecological civilization helps us to re-examine the relationship between human and nature and reflect the problem in the ecological legal system constriction, and provide enlighten for the ecological legal system.This article attempts to discuss the legal system of China's environment in the process of building the ecological civilization. Thinking from the process of establishing start of ecological civilization, and starting from the status of the environmental legal system, also combining with the current economic social development of China's specific situation and the status of the environmental protection, in order to explore the problem of China's current ecological legal system and solution, and think deeply about the process of China's ecological legal system under the guidance of ecological civilization.
