Legal Issues On Utilization And Protection Of Shiyang River Basin Groundwater Resources

Shiyang River Basin lies in the eastern part of the Hexi Corridor. With economic and social development, groundwater was drilled excessively. In recent years, the ecological environment of Shiyang River Basin was deteriorating seriously, Shiyang River Basin is facing the crisis of shortage of water. Contradiction of water became ordinary case between industry and agriculture in the middle and lower reaches of Shiyang River Basin. The level of ground water was declining sharply because of overdraft, deterioration of water caused ecological problems. So, as an important source of Shiyang River Basin, groundwater must be utilized reasonably and protected quickly. Firstly, based on the practical situation of Shiyang River Basin, such as the Water public awareness of the Shiyang River Basin, awareness of the law, administrative law-enforcement situations, analysis of the public awareness of Water in the Shiyang River Basin, the Author came to the conclusion that the public awareness of the law is very weak and environment of administrative enforcement should be further improved. Secondly, the authors expressed some problems of the groundwater in the field of use and protection in shiyang river basin. Then the author expressed the objective reasons of present situation .such as excessive increase of population, arable land continues to be expanded at the large scale , people unable understood the laws of economy and sociciety correctly. For example, It was believed that resources of the groundwater were inexhaustible, In order to expand the production of crops , many reservoirs were built in Shiyang River Basin in past years, recharge of groundwater were increasingly reduced, and even the cycle of groundwater has been changed, all these made the environment of protection and use became serious than ever before. such as lack of specific laws related to groundwater management systems, lack of effective coordination mechanisms of groundwater, lack of strong management measures for watershed management institutions, unreasonable industrial structure, weak awareness of conservation of water, capacity of water resources and the law of scientific utilization wouldn't be understood correctly, and so on.Based on combination of advanced experiences of groundwater management and market transactions of groundwater in the world, the author thought that watershed legislation of use and protection should be continuously improved, capacity of enforcement of law should be enhanced, and trading market of groundwater should be established, licensing examination and approval system should be strengthened strictly, In order to enhance the the public awareness of the crisis ,democratic management of groundwater should be explored. In addition, the author failed on analizing some issues for his limited knowledge, but I will perfect them in the future .In the end, I will be pleased if the article would do good to the use and protection of the Shiyang River basin.
