At present,there are not many researches on the patrol supervision system.Many scholars only discuss the patrol supervision in the process of studying the patrol supervision.According to the research results of the existing inspection and supervision system,it is not only a small number,but also not deep enough on the whole.Under the title of the inspection and supervision system of municipal and county Party committees,this paper comprehensively analyzes the attributes,characteristics and connotation of inspection and supervision,the origin of the system,institutions and their powers,objects and contents,development methods and procedures,connection mechanism,etc.through empirical,literature,normative and historical methods,with the intention of revealing the system connotation of inspection and supervision and showing the whole picture of inspection and supervision system,On this basis,it points out the problems existing in the current patrol supervision system and puts forward specific countermeasures.The current inspection and supervision system originated from the inspection and supervision system,which has a high degree of consistency in attributes,objectives,methods and other aspects.However,the problems to be solved,the mode of development,the position on the problems found and the main basis for system construction are different.Because the Party Constitution adopts a parallel way to stipulate inspection and inspection,based on the party constitution It should be considered that patrol supervision has the same institutional value as patrol supervision,and patrol supervision is not an accessory of patrol supervision.Patrol supervision is inner-party supervision and Party committee supervision,which is a relatively rigid supervision.Patrol supervision has the characteristics of comprehensiveness,authority,indirectness,periodicity and flexibility,and has the effect of "re supervision".The source of inner-party laws and regulations has only principled provisions on patrol supervision,and a large number of specific rules are provided by inner-party normative documents.However,after the Party Constitution stipulates inspection and inspection respectively,they have been specifically worded,so it is difficult to interpret inspection as inspection.At the same time,it is obviously contrary to the spirit of ruling the party according to regulations to carry out inspection and supervision according to the normative documents within the party.We should formulate the inner-party regulations of the Central Committee on patrol supervision or amend the regulations on patrol work,so that there are rules to follow in patrol supervision.There are many organizations participating in patrol supervision.However,some organizations have many deficiencies in coverage,applicability,rationality and legitimacy.It should be clear that the plenary session of the Party committee participates in patrol supervision,that the municipal Party committee leads the patrol supervision at the municipal and county levels,that the dispatched organs of the municipal Party committee lead the patrol supervision in the areas under their jurisdiction,and that the "special meeting of secretaries" should be standardized,The Secretary of the Party committee shall be the leader of the leading group for patrol work.The patrol office of the Party committee shall be truly departmental and return the authority of special inspection to the patrol group.As the patrol supervision is carried out in the "acquaintance society" of cities and counties,it belongs to the work of "looking for trouble",and the relevant incentive mechanism has not been fully established,it is difficult to ensure the work enthusiasm of the leader,deputy leader and patrol staff of the patrol group.More part-time personnel participate in patrol supervision,and their professionalism is difficult to be guaranteed.We should enrich the strength of the patrol office,establish a professional patrol supervision team,strengthen the training of patrol personnel and improve the professional quality of patrol personnel by formulating unified inner-party normative documents.The inspection and supervision institutions enjoy many functions and powers,and the functions and powers of some institutions have problems such as inappropriate subject,incomplete content and lack of supervision.It is necessary to clarify the right to start the inspection and supervision,the right to review and publish the inspection plan for the municipal and county Party committees,and the right to propose the inspection planning enjoyed by the inspection leading group The right to listen to reports and the right to management and supervision should be further refined to enhance practical operability.The inspection team should be given the right to make personnel suggestions,improve the actual status of the inspection team,and give the inspection office complete supervision power to ensure the final effect of inspection and supervision.The object of patrol supervision is the party’s leading group and its members.It is based on the party organization to judge whether to realize the "full coverage" of patrol supervision.However,this standard may make the supervision object omitted and make the rectification of patrol supervision meaningless.We should change the organization as the standard to the individual leading cadres as the standard to ensure that there is no omission in patrol supervision and that the rectification is effective.From the perspective of the actual operation of patrol supervision,patrol supervision is "same body supervision" and "supervision at the same level",which sometimes leads to the problem of "down patrol and up".The plenary session of the municipal Party committee should be included in patrol supervision,the qualification of patrol supervision subject of county-level Party committees should be cancelled,and the Standing Committee departments of Party committees should be promoted to a higher level to solve the problems caused by inappropriate supervision methods.Although there are some procedural contents in patrol supervision,there is a great lack of supporting procedures such as substantive power,which may lead to the alienation of the system in the process of implementation.We should further supplement and improve the missing procedures,refine the existing procedural provisions,and bring the exercise of power into the track of procedural rule of law.
