The Construction And Empirical Research Of The Patent Threat Early Warning Model For Pharmaceutical Enterprises

Objective:With the arrival of the era of knowledge-based economy,patents have become the focus of international economic and trade conflicts,and are important capital for transnational corporations to participate in international competition.Under this circumstance,the patent threat becomes an important part of the company's external threat and it is the main factor that threatens the development of the company in the current external competitive environment.Due to the characteristics of long research and development cycle,large initial investment,strong technology dependence,and high patent-intensive and profitable characteristics of the pharmaceutical industry,threat events frequently occur in the pharmaceutical industry,bringing about a huge impact on the survival of pharmaceutical companies in China.In order to assist Chinese pharmaceutical companies to effectively perform patent threat early warning and timely respond to patent threats in an external competitive environment,this paper conducts in-depth discussions on the theories and methods of patent threat early warning,and focuses on the model of patent threat early warning.Methods:From the perspective of informatics,this paper comprehensively applies the competitive intelligence theory,signal analysis theory,enterprise crisis management theory and enterprise early warning management theory to explore the connotation of the enterprise patent threat warnings,and analyzes in depth the forms and sources and the early warning process of corporate patent threats.Based on this,this paper adopts the basic idea of patent portfolio theory and builds the enterprise patent threat early warning model.Also the methods and techniques of text analysis,data mining,mathematical statistics and information measurement are comprehensively used to explore and optimize the measurement methods of each dimension in the enterprise patent threat early warning model.Finally,this paper selects a Shanghai pharmaceutical company as the research object,carries out an empirical study,and evaluates the feasibility and validity of the enterprise patent threat early warning model.Results:(1)This article explores the root causes of patent threat events from the perspective of the company's external environment and internal environment,builds an "onion" model for the source of corporate patent threats,and systematically analyzes the connotations of the sources of patent threats.(2)This paper summarizes nine types of patent threats including patent infringement lawsuits,patent barriers,patent jungles,patent fishing baits,patent cliffs,etc,and conducts in-depth analysis of the basic features and causes of the various patent threat manifestations.(3)This paper proposes an enterprise patent threat early warning process that takes the competitive intelligence process and signal analysis process as the main line,and the patent threat information acquisition and patent threat information utilization as the core steps.(4)This paper builds the enterprise patent threat early warning model from the product level,the industrial environment level,the technical level,the staff level and the integration level.(5)This paper explores and optimizes the eight measurement dimensions of the measurement methods in the enterprise patent threat early warning model.The eight measurement dimensions include technology gaps,technological differences,relative technological capabilities of the research and development,core technical personnel attractiveness of the research and development,relative market share changes,industrial attractiveness,Industrial structure,and relative competitive position of enterprises.At the same time,this paper analyzes the measurement process of six assessment dimensions.The six assessment dimensions include the technology maturity,the technology research and development focus,the technical staff collaboration intensity of the research and development,the technical research and development personnel coverage,the product life cycle and the product market demand degree in the model.(6)Using the enterprise patent threat early warning model proposed in this paper and related theories and methods,this paper evaluates and alerts the patent threats faced by a Shanghai pharmaceutical company in various technical fields.Conclusion:(1)Technology,staff,products,industrial environment and macro environment are the direct sources of enterprise patent threats,and they also constitute the "onion" model of enterprise patent threats.(2)The alert process for enterprice patent threats includes the process of competitive intelligence and signal analysis.Its core task is to obtain and utilize patent threat intelligence.(3)Using the enterprise patent threat early warning model,this paper can evaluate and alert the patent threats faced by enterprises in various technical fields from multiple dimensions and multiple level at the same time.(4)Using text analysis,data mining,mathematical statistics,and information measurement methods and techniques,this article can effectively measure various evaluation dimensions in the enterprise patent threat early warning model.(5)The enterprise patent threat early warning model has good feasibility and effectiveness.The enterprise patent threat early warning model can effectively compensate for the deficiencies of the existing methods.
