Overall strength of the country gradually depends on the level of science and technology in the present, and increasingly, intellectual property right (IPR) also becomes to be the focus of economic development in every country, which is efficient path to raise its international competitive ability. As a new type of IPR, the intention of protection of new varieties of plants (PVP) is to encourage breeders to develop new varieties of plants for farmers's use, in order to promoting the agriculture and forestry.International studies on the PVP have been in scale, however, to implement the PVP for too short a time to take many studies in our country. The paper would study on the impact of the PVP in the seed industry of China, which couldn't only survey how the institution of the PVP is, but also explore how to stimulate breeders continually innovating and its influential factor. It is important to correlate the institution of the PVP with the seed industry to study so as to encourage the innovation of agricultural technology, to promote the marketization of seed industry, and to settle problems of agriculture, farmers and countries.The following is the research contents of the article. Through the study on the institution of the PVP of forefathers, the anterior are important foundation stone. the paper analyzes the effects of the PVP to the development of seed industry in our country, stressing on introducing the performance mechanism of the PVP in our country and its management model, comparing the institution of the PVP in our country to American and Japanese. Then through the first hand datum gained from field survey, sending questionnaire and telephone, the paper demonstrates and analyzes effects of the PVP to the breeding innovation of seeds in our country, acquiring the main influential factors. Moreover, changes between domestic and international seed markets are discussed by statistic data. Taking the case of garlic seed industry, the paper discusses challenges to the development of seed industry and its effects after our country joining in UPOV 1991 ACT. Based on the theories study and demonstration analysis, the paper provides some suggests in allusion to problems that the institution of the PVP presented, so as to bring the advantages of the institution of the PVP into play to promote the development of seed industry in our country.In demonstration analysis, the article constructs a theory model related to investing the research and development of breeders. The breeders would invest the research and development of new varieties depends on the derivative demand for new varieties of farmers (it also depends on the last demand its output when the new varity was inputed), the price made to by breeders (decided by the level of IPR) and competition on the research and development market and so on. Consequently, the produce market, seeds market and the research and development market would be got together and put into the model, which analyzes the investment decision-making of breeders while several related markets get to equilibrium. The results of demonstration in article appear that the level of protection of plant new varieties (depending on the perfect degree and the performance strength) impacts the enthusiasm of research and development of breeders positively.
