Study On The Patent Focus Strategy Under A New Condition Of Open Innovation

Open innovation not only improves patent exchange, but also accelerates the innovation activities of the specialized division of labor. Some patent-holding companies focus on certain aspects of the value chain and obtain the benefits by collecting those separate patents in certain technical fields, which shows a new strategic type that we can define it as patent-focus strategy. Take three typical companies as examples, which are Intellectual Ventures (â…£), Allied Security Trusts and RPX Corporations, the dissertation discusses the impact of patent-focus strategy on indigenous innovation in China and provides some references and suggestions to the national policy. The main content and innovations of the dissertation include:Firstly, based on focus strategy and niche strategy theory, this dissertation introduces patent-focus strategy by summarizing the business models of foreign patent-holding companies and defines the concept of patent-focus strategy from the perspective of strategic management, which is a strategic behavior that company selects a specific breakdown of competitive advantage, technical fields and collect patents to obtain the benefits as much as possible. The patent-focus strategy is different from traditional patent strategy in five aspects:strategic level, patent integration desire, patent management model, relationship with the patentee and profit model.Secondly, this dissertation theoretically explains the impetus of patent-focus strategy at the following levels:open innovation, specialized division of innovation and patent value. It also reveals that the expansion of production of capital investment, positive incentives of increasing return and reduced transaction costs are the most important factors which affect the establishment of the patent holding companies and selection of patent focus strategy.Thirdly, according to the paper, patent-focus strategy can be divided into two types: patent differentiation focus strategy and low-cost patent-focus strategy. On one side, patent-focus strategy has spillover effect on indigenous innovation in China, which plays a positive role in promoting the transformation of research achievements and preventing the attack from patent trolls. On the other side, patent-focus strategy possibly erodes the foundation of indigenous innovation in China, which increases the cost of patent acquisition and the risk of patent litigation.Finally, the author provides some references and solutions at the national policy level. Policy references includes:(1) it is necessary to help the enterprises to transform their business model to an open innovation model; (2) it is needed to establish a sound system of the commercializing patent, accelerate Patent transaction platform mechanism, strengthen market-oriented process of innovation and boost the combination of venture capital and intellectual property. The suggestions are mainly about the following aspects: (1) the government should guide private enterprises to jointly form national patent-holding companies, which can gradually realize market-oriented patent operation; (2) the cooperation between academic institutes and foreign patent-holding companies in patent business should be normalized as soon as possible; (3) universities and enterprises must strengthen security consciousness in the cooperating process.
