We seldom consider our schooling from the angle of view of rights and with the discourse of rights. This has resulted that in Chinese schools the superintendent and teacher have too much power to invade the student's freedom and rights they originally should have at will. In view of this fact, this research means to use the discourse of rights to ponder and analyze some phenomena and questions of management and teaching from student's angle, thus delimit some certain borderlines for the school and teacher's educational power.The word "rights" is the discourse of political philosophy, therefore, in a way, to utilize the discourse of rights in our schooling is to regards education as a political event. But, education has its particularity after all, therefore, we must avoid analyzing the student rights roughly with the general theories of political philosophy. This research emphatically analyzes the phenomena and questions of education with the concept frame of rights. Therefore, in the first chapter, this research mainly considered the. concept and implication of rights from the significance of instrument, but didn't discuss the theories of values of rights too much. Based on this, this research pondered the particularity of student's rights, that is: We should mainly analyze student's rights in student's spiritual life; Student is the subject of benefit of rights, but, because of his intellectual immaturity, may he is unable to claim for his benefits personally, thus here he needs to have the adult to substitute the position.The concept "Student's rights" approximately appeared in the second half of this century, while the ideas on student's rights have bred from the ideas on child, and the ideas on child also become more and more mature along with the influence of the ideas of human rights. Therefore, the thinking on the student's rights must trace back to the evolution on the ideas of children. Here, I look back on the history of student's rights in three ways:: First, I divide the ideas of children in the history of the western thoughts of education into three types; Second, I trace back to the history of our country's thoughts of children. Third, I review the clue of progress on the international protection for the rights of children in the 20th century. In the second and the third chapter, I elaborate these three kinds of historical review clue in detail.In our country, as far as the legislation protection for the rights of student and children are concerned, we have accomplished some achievements.
