Study On The Legal Issues Of Student Management In Colleges And Universities In China

Economic development promotes the effective implementation of the Strategy of Governing Country by Law.Speeding up the process of legalization contributes to developing the rule-by-law in education,and then the behavior management of university students is gradually on the road of legalization.The rule of law,as a the basis of establishing modern university system in Colleges and University,is the necessary conditions for the realization of scientific development in Colleges and Universities.Therefore,combining law with students management in Colleges and Universities is not just a subject of attention and study for higher education researchers,but also an important field where university administrators and practical works explore and practice at the moment.In recent years,school sued by the students cases happening presents ever-increasing tendency.For instance,Southwest Politics and Law University had been sued by Lv guang guan,Shenzhen University had been sued by Ruan xiang hui,Wuhan University Of Technology had been sued by Bai zi shan,Wuhan Institute of Technology had been sued by Wang ling.These cases reflect many legal problems that exist in college student management.At present,there are many phenomena that causes imbalance of power between universities and students.For example,the legal of colleges and universities is unclear.The law of students management in colleges and universities is too generous and its' interoperability is not strong.Exercise the right of disposition of universities is improper.The rule of law is a systematic project.Through integrating theory with practice,this paper is based on a brief survey of legal status of colleges and universities and the legal relations between universities and students.This paper,based on disputes and conflicts between universities and students,makes the most of Education Law,Administrative Jurisprudence and Education Management theory etc,and then analyzes systematically some law problems and challenges that inhere in activities about the administrator of the university punishing students.A series of feasible countermeasures,which is directed against how to solve problems in management of students in colleges and universities,are put forward,such as optimize the legal environment of colleges and universities,perfectingeducational legislation,improving the formulation of internal rules and regulations in colleges and universities,focusing on procedural relief,education Arbitration and litigation.So as to truly promote the law school and safeguard the legitimate rights and interests of students.
