The Analysis On The Student Rights Guarantee In The Student Status Management In Universities

Student status management is an important component of teaching and students adminstration in universities, which is related to the evaluation of student study qualification, learning condition and learning outcomes. It is also one important manner to administer students. Student Status Management is to ensure the normal teaching order, construct good style of study, teaching style and ethos and do great contribution on the development of the school's level and quality of personnel training. With the promotion of market economy and the development of the process of state law, students'awareness of the rights increased. In March 2005, the Ministry of Education promulgated a new "University Students Administrative Regulations" (Ministry of Education, No. 21) .The new regulation pays more attention to the spirit of"managing according to law", enhancing the recent successful experience in educational reform and expanding the autonomy of the university, furtherly clarifying the rights and obligations of students, standardizing student status management of the university. However, there are still some problems in the specific implementation of student status management. For instance, student status management in colleges and universities emphasises more on its observation function, which represents the school management on students, ignores its encouragement function. It will lead to the weakening of the status and rights of students, the fomalization and superficialization of maintaining the interests of students in student status management process. Students legal awareness is still weak. There are still some cases on violations of student rights in some universities. There is no difference among universities on student status management. It is difficult to adapt to the teaching management system which works at the students personality development and the school idea of innovation talents education.Based on the analysis and explaination of the current student status management system of universities in China, the problem analysis of students rights protection in student status management, combining with the domesticly reform practice on student status managemnt, discussion on the methods of establishing and improving student status management from different points of view such as the conflict between student status self management and student right to education, student interest and right protection, educating students with top priority, school adminstration by law, this paper puts forward a new conception of student status management system in universities of China to provide reference on the research of university student status management system.
