The Research On Innovation Regime Of Ecology Protection On The Circumstance Of Colletive Forest Right Reform

Into the21st century, Chinese modern forestry development strategy has beenproposed which emphasized that ecological construction was the main road tosustainable forestry development, and ecology protection has become one of theimportant topics of modern society. However, with the spreading of reform ofcollective forest tenure and the two shifts of forest ownership structure and operationof protection collective forest area, the practices of ecological protection policies incollective forest areas were in a dilemma. The paper aimed at optimization andinnovation of ecological protection policies and measures to build the CollectiveForest ecological protection institution compatible with the reform of collective foresttenure. First adaptability of the existing Environmental Protection Policy in thecontext of collective forest tenure reform was analyzed; then institutional frameworkof ecological protection in the context of collective forest tenure reform was discussed;last in this basic framework and three chapters, optimization and innovation ofspecific measures under the three policy instruments of motivation, support andconstraints of ecological protection policy in the context of collective forest tenurereform were analyzed in three chapters. The analysis results showed that the policyobjectives, instruments and existing of ecological protection are incompatible with theshifts in collective forest area after the reform of collective forest tenure; and pointedout that under the corresponding idea and principle through the"goal-means-measures" three levels of policy construction method to build thepreliminary ecological protection institutional framework in the context of collectiveforest right reform; the paper to indicate the optimization of conventional governmentmeasures and innovation to incentives by introducing market mechanisms can greatlyincrease the enthusiasm of the farmers’ ecological protection; two funds support of theestablishment of collective forest mortgages and policy forest insurance policies, andstrengthen farmers’ forestry professional cooperative organizations and the forestmanagement plan preparation service system is an important measure to protect thefarmers from continuing operations and protection of forest resources; Innovation offorest harvesting management and actively use of village rules etc., institutionalconstraints and connecting with the innovation to two man-made constraints of thecollective forest resources supervision and monitoring can be used as an effectivesupplement instruments of incentive and support, to construct the whole innovation of the ecological conservation institution under the background of collective foresttenure reform. Finally, it is concluded that to must follow principles of“balancebetween private and right”and to respect the farmer’s various rights or farmers’"private rights" in collective forest management, and balance between "private rights"and "right" of social public pursuit of ecological benefit is basic of the effectiveinnovation to ecological conservation institution under the background of collectiveforest tenure reform.
