Scientific Papers Research On The Copyright Protection Of Network

Scientific paper is one of the important forms of the output of science and technology activities, and a historic document which records human’s scientific and technological progress as well. The purpose of network copyright protection on scientific paper is to promote technological and cultural innovation, improve the quality of scientific paper, and to make scientific papers widely and internationally shared.To reach these goals, the sharing of scientific papers through the Internet needs to be restricted by the following three principles of copyright protection:1.To respect authors’priority.2.To respect users’legitimate rights to use;3.To maintain the balance of the interests of the sharing and the protection. The approaches of copyright protection in scientific paper’s network sharing are as follows,1.To be complied with the guiding principles of networks copyright policies in scientific paper.2.To build a multiple authorized mode of scientific paper’s online publishing.3.To strengthen and protect the special copyright of the online scientific papers.4.To establish the balance mechanism of interests among different individuals.The paper firstly expounds the attributes of scientific papers, the meaning of online publication, the types of scientific papers, and the way of scientific papers online publication.Second, the paper searches the literature from1994to2012through databases like cnki, cqvip, wanfangdata and SpringerLink, using keywords as scientific paper, information sharing, network sharing, copyright protection, online publishing, combs the development status of scientific paper’s network sharing movement home and abroad, analyzes the constraints of network sharing, as well as issues about copyright protection.Then, on the basis of describing the meaning and scope of copyright protection, the article begin to study the jurisprudence basis of copyright protection of network sharing in scientific paper-interest balance mechanism of copyright law, which including copyright restraint system, relationship between copyright protection and network sharing, differences and coordination of copyright system, along with relationship between network copyright and traditional copyright.Finally, the article selects five well-known network sharing platform of scientific paper home and abroad, including American arXiv.org, Germany Springer Open Choice, Chinese sciencepaper online, NSTL and Qiji.CN/Eprint., to investigate data, collate its development status. Based on those, the article summarizes the copyright protection’s countermeasure of network sharing in scientific paper:1.Government role:Facilitate legal sharing of scientific paper cross the area of the law.2.Sharing platform:Establish incentive mechanism of copyright supervision.3.Means of protection:Perfect copyright protection’s technical system of network sharing in scientific paper.
