In recent years,the game industry,which plays an important role in promoting the development of China's Internet economy and stimulating cultural innovation and creativity,has developed rapidly.But there are still some problems.Some "businessmen" who are tempted by high profits,are unwilling to work hard to be original.As a result,it makes the "copycat" works in the online game industry rampant and the original creators suffering.Online games are new things.Due to the stability and lag of the law itself,there is a lack of unified regulations.It causes some confusion in practice that different judgments in the same case occurs from time to time,which affects the efficiency and results of the trial.It makes it difficult to provide reasonable legal protection for the copyright of online games.Therefore,it is necessary to clarify the relevant concepts and unify the cognition.The introduction part of this paper mainly introduces the research background.The second part introduces the development of the game industry,its unique characteristics compared with the traditional industry,and the necessity of copyright protection for online games.The third part introduces the current legislative and judicial protection of online games,and what kind of aid can be provided by administrative law,as well as the protection of industry self-regulatory organizations.The fourth part is the key chapter of this paper.The viewpoints of this paper are drawn after the interpretation of several controversial contents and discrimination of several protection methods in this chapter.The game screen is the core content of online games.In the process of player ' s operation,the system will transmit the corresponding game screen to the screen,allowing players to enjoy the game intuitively.The identification of the attribution of the game screen is the basis for copyright protection of online games.Only after clarifying the attribution of the game screen can we discuss how to solve the infringement problem of copycat games.Whether a game player can become a copyright owner or not depends on the wisdom and have more autonomy,such as MOD games.Then they can be the copyright owner.Whether stealing the rules of a game is an infringement,and what kind of rights it infringes,are problems in practice.The key to the solution is the attribution that whether the rule is in the public domain and whether it is a limited expression.The protection mode of online games is not unified.Through the comparison of several modes,it is concluded that the overall protection of the game is conditional,and the protection of specific parts is not limited.When the copyright law cannot protect the rights of the copyright owner,and there is a disruption of orderly market competition,the Anti-Unfair Competition Law can also provide aid.This is in line with the law and the expectation of the copyright owner.In the last part,some suggestions are put forward,including the use of interpretation theory,flexible use of bottom line clauses,introduction of experts and so on,hoping to contribute to the copyright protection of online games.
