Study On The Crowdsourcing Dispute Resolution On Network Platforms

With the development of the Internet business model into a platform,the network platform has gradually become a new infrastructure of society,deeply embedded in the real social production life,and having an important impact.However,the multilaterally connected nature of online platforms has led to a sharp increase in online disputes and a more complex situation,affecting the order of cyberspace and the sound operation of real social life.In the face of the volatility,fragmentation and changeability of online disputes,traditional dispute resolution mechanisms can hardly meet people’s demand for immediate and efficient dispute resolution,and at this time,Crowdsourcing Dispute Resolution on Network Platforms("CDRNP")was born.It is born from the autonomous management mode of online communities,supported by Internet information technology,and combined with the procedural design of jury system,and plays an important role in the dispute resolution of online platforms.Due to its late start,China lacks theoretical research and policy support for CDRNP,and the mechanism is not perfect in terms of institutional regulation and construction of related supporting facilities to achieve better and wider governance effects.Therefore,this study aims to conduct a holistic examination of the existing mechanisms at a time when the practice of CDRNP is emerging.Firstly,to conduct a comparative analysis of the operational mechanisms and effectiveness of the representative CDRNP at home and abroad in conjunction with the research results of crowdsourcing theory and dispute resolution mechanisms,so as to form a framework of dispute adjudication that can operate effectively and has wide applicability;secondly,to assess the objective procedural fairness of the above mechanisms by reviewing Second,by reviewing the objective procedural fairness of the above mechanism and assessing the subjective fairness,the fairness assessment criteria and specific explanations of the dispute adjudication mechanism are improved.In addition,this study provides legal,procedural,and technical suggestions for the future development of the CDRNP based on the summary of its functions and values.Specifically,the CDRNP should bring together the energy of all parties while highlighting its unique advantages of autonomous management,convenience,fairness,and efficiency,enhance legitimacy through legal recognition,optimize procedural design to ensure reasonableness,and apply new technologies to improve the quality and efficiency of dispute resolution.It should not only be able to better solve all kinds of online disputes,but also provide reference experience for other social governance fields and contribute to the maintenance of cyberspace and the sound operation of social life.
