The international financial market has not yet fully recovered from the turmoil triggered by the trade friction between China and the United States in 2018,and the world is under the grip of the new COVID-19 epidemic in 2020,the demand for trade in major commodities in the international market is insufficient,trade barriers and anti-dumping investigations in developed countries are escalating,trade protectionism is increasingly obvious,and the world economy may remain in a long-term slump.The international environment facing China is becoming increasingly complex,and the structural upgrading of export products has been brought to a more important position.The importance of exploring the mechanism of intellectual property protection affecting the structural of Chinese export products cannot be overstated.To explore this issue,this paper provides an in-depth analysis using a combination of theoretical analysis and empirical tests.In the theoretical analysis section,the relationship between intellectual property protection and export trade is theoretically analyzed on the basis of literature research,it is found that IPR protection can promote the upgrading of China’s export product structure through technological innovation and foreign direct investment,and based on the collected data,the trajectory analysis method was used to review the development status of the key variables in the paper and construct the indicator system of this paper.In this part of the paper,we first review the legislation and enforcement of intellectual property protection in China,then analyze the technological innovation from the perspective of input and output respectively,then analyze the current situation,characteristics and problems of FDI development,and finally elaborate the evolutionary process of China’s export product structure from the perspective of macro structure,technology intensity and factor intensity respectively,and divide the export manufactured products into four major categories according to their technological content to construct the export product structure index.Based on the above-mentioned literature research and development status study,this paper deduces in detail how IPR protection affects the structure of export product through technological innovation and FDI respectively at the theoretical mechanism level,and points out that there is a strong correlation between technological innovation and FDI,and deduces three intermediary paths through which IPR protection affects export product structure.In the empirical test section,country-level time series data are selected to explore the issue of structural upgrading of export products from the perspective of product technology content.A chain multiple mediating effect model with IPR protection and the structural of export products as independent and dependent variables,respectively,and technological innovation and FDI as mediating variables is used to investigate in depth the impact and mechanism of IPR protection on the structural of export products in China.After meticulous theoretical research and empirical testing,this paper draws the following conclusions.(1)There are direct and partial intermediary effects of IPR protection on the structural of export products,and the number of paths that produce partial intermediary effects are two,namely,"IPR protection → technological innovation → upgrading of export product structure" and "IPR protection→technological innovation→FDI→upgrading of export product structure".(2)The sign of the direct effect of IPR protection on the upgrading of export product structure is negative,which is a significant masking effect.Therefore,this paper believes that IPR protection has a weak inhibiting effect on the upgrading of China’s export product structure in general.(3)Among the intermediary paths through which IPR protection affects the structural upgrading of export products,technological innovation plays a pivotal role.The IPR protection mainly promotes the structural upgrading of export products through technological innovation,while FDI makes a relatively small contribution in the process of structural upgrading of export products.Therefore,China must promote the construction of IPR protection system from the legislative level and law enforcement level,build a differentiated domestic IPR protection system,proactively and moderately promote further rationalization of IPR protection,increase the intensity of R&D investment,encourage domestic enterprises to carry out technological innovation activities,create their own brand advantages,adjust the foreign investment introduction mechanism,introduce high quality foreign investment and strictly control its flow,and make medium and High-tech manufactured products as the leading export products so as to promote the upgrading of China’s export product structure.
