Under the background of the modern sharing economy,the platform business model has been supported by many enterprises due to its advantages of linking supply and demand in a timely manner and efficiently allocating resources.However,with the rapid development of the business model of modern sharing economy platforms,it has also raised legal issues such as labor relationship identification,labor rights protection,sexual assault and harassment by Didi drivers,and management problems such as platform-based flexible employment.From the analysis of labor relations as the research object,the particularity of fuzzy labor relations in the modern sharing economy is an important reason.Therefore,how to manage the fuzzy labor relations under the modern sharing economy and build a new type of harmonious labor relations in my country is a theoretical and practical topic that should be discussed and studied in depth in the academic circles.Therefore,this study considers the significant changes brought by the rapid development of the modern sharing economy to labor relations,and is based on the particularity of the ambiguous labor relations under the modern sharing economy,namely autonomy in form,restriction in content,and concealment in means,taking the mining of the influencing factors of fuzzy labor relations as the pilot analysis,taking the governance path of fuzzy labor relations as the core analysis,and taking the dynamic game rules of fuzzy labor relations as the expansion analysis,starting from the whole process of the formation,development and continuous improvement of fuzzy labor relations,A systematic and comprehensive study has been carried out on the governance of fuzzy labor relations under the modern sharing economy.conclusion as below:(1)About the influencing factors and influencing mechanisms of fuzzy labor relations under the modern sharing economy.The study found that the fuzzy labor relationship in the modern sharing economy is affected by both internal and external factors.As far as external factors are concerned,the macro environment,consumer attitudes and behaviors indirectly regulate the fuzzy labor relationship under the modern sharing economy by affecting platform management and worker acquisition;as far as internal factors are concerned,the psychological relationship between modern sharing economy platforms and service providers The contract directly affects the fuzzy labor relationship in the modern sharing economy.The observance of the transactional contract is the "foundation stone" for the normal development of the fuzzy labor relationship in the modern sharing economy,and the observance of the relational contract is the "lubricant" for the healthy development of the fuzzy labor relationship in the modern sharing economy.”,the observance of the developmental contract is the “long-term medicine” for the harmonious development of fuzzy labor relations under the modern sharing economy.(2)Regarding the multiple governance paths of fuzzy labor relations under the modern sharing economy.First of all,there is only one path for the construction of harmonious and fuzzy labor relations in the modern sharing economy.The path of building a harmonious labor relationship based on “warming up and promoting development”,that is,the mutual compliance of transactional psychological contracts and developmental psychological contracts can promote fuzzy labor relations.harmonious development.Secondly,there are three prevention and control paths for non-harmonious and ambiguous labor relations,which are: "no food and clothing,no belonging",invalid "development","no food and clothing,no development" and invalid "belonging" and "no belonging,no development" The invalid "subsistence".Finally,the construction path of harmonious fuzzy labor relationship and the prevention path of disharmonious fuzzy labor relationship together constitute the multiple governance path of fuzzy labor relationship under the modern sharing economy.(3)Regarding the continuous improvement of vague labor relations under the modern sharing economy.Aiming at the phenomenon of illegal operation of shared travel drivers caused by ambiguous labor relations in the modern sharing economy,the study found that: first,the shared travel industry will be stable for a long time in the three categories of "good without governance","chaotic but without governance" and "governance without results".Such a situation,in which there was a phenomenon of consumer speculation and bad reviews,but ultimately consumers stabilized with reasonable evaluations.Second,managing the phenomenon of illegal operation of drivers is the key to promoting the healthy development of the shared travel industry.If the net income of the driver’s compliant operation is effectively controlled to be greater than the net income of the illegal operation,the driver will be stable in the compliant operation.At this time,consumers lack the motivation of unreasonable evaluation,and the platform does not need to spend the cost to carry out strict supervision,so as to stabilize the industry in a good situation of "no need for governance".Third,the situation of "chaos without governance" and "governance without results" can be transformed into a "good without governance" situation through three major measures: raising the driver’s illegal operating costs,increasing the customer turnover rate,and reducing the platform commission rate.Fourth,under the platform’s strict supervision mechanism,the punishment of driver negative reviews can be dealt with in a short-term manner,but it cannot eradicate the phenomenon of illegal operation of drivers.(4)Finally,a multi-subject co-governance model of fuzzy labor relations under the modern sharing economy based on psychological contract is constructed.Specifically: First,between the modern sharing economy platform and service providers,the transactional psychological contract and the developmental psychological contract should be paid equal attention;secondly,the transactional psychological contract and the developmental psychological contract should be combined between the modern sharing economy platform and consumers.Relational psychological contracts in parallel.Third,consider both transactional and relational psychological contracts between consumers and service providers.The research in this chapter provides ideas for the Chinese government to supervise and guide the healthy development of the modern sharing economy,and provides countermeasures and suggestions for the governance of fuzzy labor relations and the construction of harmonious and fuzzy labor relations for platform enterprises under my
