From “the Five-year Plan for the Development of Family Education” in 1996 to “The law of the People’s Republic of China on the promotion of family education” in 2022,the development of China’s family education has transitioned from spontaneous to conscious,and from policy guidance to legal protection.Under the macro guidance of national legislation on family education,improving local legislation on family education is a key factor in promoting the modernization and level of governance in the field of family education,and it is an inevitable choice to promote the harmonious and stable development of family education.This paper takes local legislation on family education as the research object and uses literature research methods,content analysis methods,and case study methods to conduct a comprehensive and systematic study on issues related to local legislation on family education.Firstly,there are problems with insufficient legislative interpretation and lack of protection of family education rights in local legislation on family education,which urgently requires effective paths for legislative revision and improvement based on analyzing regulatory texts and examining practical situations.Local legislation on family education follows the evolution of policy changes,going through three stages of construction,formation,and promotion,from entering the policy agenda and forming a policy system to clarifying legislative requirements.The legal text of local legislation on family education is in the form of promotion regulations,with content including family,government,school,society,and law,aimed at promoting the development of family education in a weak position.Secondly,after analyzing the regulatory text of family education in nine provinces and one city,it was found that there is an imbalance and inequity in the rights and obligations of responsibility subjects,a lack of protection for parental education rights,a lack of local characteristics in regulatory text,a high degree of repetition and insufficient relevance to reality,difficulties in delineating public and private rights and lack of support for public resources making it difficult to execute various provisions.Therefore,taking the time of promulgation and regional characteristics of local legislation on family education as a starting point,Chongqing City,Fujian Province,and Hunan Province were selected as case studies to conduct in-depth research,demonstrating that the improvement of local legislation on family education can be promoted through issuing documents,establishing mechanisms,formulating policies,and optimizing systems.Finally,based on the textual analysis,problem analysis,and case study of local legislation on family education,optimization strategies for local legislation on family education are proposed.Firstly,clarify the upper-level laws and other legal bases of local legislation on family education.Secondly,establish the principles of maximizing the rights of minors,safeguarding parental education rights,and prioritizing the rights of minors in special circumstances in local legislation on family education.Thirdly,propose an optimization path for local legislation on family education that includes improving legislative techniques,highlighting legislative characteristics,and enhancing legislative evaluation,in order to promote the process of local legislation on family education,address its deficiencies,and improve its effectiveness and level.
