| Family education is a lifelong education for a person's growth. Good family education mode can promote children's healthy and happy growth, and also can help children obtain the rights such as:subsistence right, protection right, development right and participation and so on. However, in the realistic society, the gap between idea and practice become great, the structural pressure enhanced, the conception "education prepared for adults" is unprecedentedly institutionalized, structured and functioned. Children are looked as family and family membership's possession, the parents put their will and value standard on children, consider children's own needs and wishes seldomly.Because of the natural kinship ties, family education has the basic position in children's growth process. As the special protection mechanism, family education law plays the role of escort on family education's development. At present, our children's family law protection is in the marginal status, family education shows excessive, lack and illegal phenomenons etc. In view of the situation of family education now, the dispute of establishing a special family education law is quite a lot. The paper perspective the family education legislation from the degree of children's rights protection. On the theory basis of foreign and Taiwan's family education legislation, the author think the family education legislation can't accomplish in an action, it's a long winding process. Family education legislation focuses on the success, and not on the process. In views of above, the author thinks that family education legislation's perfect protection system needs parents' updating concept, the complement of family education legislation system, the execution and supervision mechanism of family education law, the family education's social support system etc. Only do this, the family education can develop healthy and provide a free broad space for children's growth. |
