| The rule of law is an important guarantee for national governance,which is reflected in education.The fundamental purpose of administering education according to the rule of law is to fully implement the Party’s educational policy,realize the goal of fostering virtue through education,and nurture a new generation of capable young people with sound moral grounding,intellectual ability,physical vigor,aesthetic sensibility,and work skills who will fully develop socialism and carry forward the socialist cause.The realization of college students’ democratic management right reflects the students’ pursuit of individual freedom and all-round development,and highlights the students’ sense of social responsibility and citizenship.The realization of this right not only reflects the quality of talent cultivation,but also represents the level and effectiveness of law management in colleges and university.Against the background of the law-based governance at the country level and school level,this research adopts questionnaire and interview to investigate the current situation of the realization of college students’ democratic management right based on the concept of college students’ democratic management right and related theories.And SPSS23.0 data statistical software is used to process the data obtained from the questionnaire survey.The analysis of means shows that the average means of the realization degree of students’ democratic management right is 3.29.The realization degree of students’ rights of information,participation,expression and scrutiny is basically consistent with the overall realization degree of students’ democratic management right,which indicates that the realization effect of college students’ democratic management right is not ideal.The difference analysis shows that the realization degree of college students’ democratic management right is significantly affected by the position and political affiliation.At the same time,after having the in-depth interviews with 5 students and 5 student affairs administrators,it can be seen that the current students’ attitudes to realize the democratic management rights can be divided into three types: "active striving type","discipline conservative type" and "passive avoidance type".On the basis of mastering the basic situation of the realization of college students’ democratic management right,this paper analyzes the factors that affect the realization of college students’ democratic management right from subjective and objective aspects.The subjective factor is the consciousness of right and the ability of right,which is manifested as:the vague cognition of right and the weak claim of right limit the behavior of college students’ democratic management right,and the difference between the intrinsic ability and the compound ability affects the opportunity and scope of exercising the democratic management right of college students.As for the objective factors,its analysis is mainly carried out from the school level and the social level.At the school level,the management ability of student affairs administrators affects students’ consciousness of rights and feasible ability,the construction of rules and regulations affects the concrete practice of students’ exercise of democratic management right,and the performance of organizational institutions affects the realization effect of college students’ democratic management right.At the social level,the expression mechanism in the Internet era impacts on the procedure of rights realization,and the traditional concept of social etiquette and custom affects the establishment of the cultural concept of the rule of law.Finally,based on the analysis of the factors affecting the realization of the democratic management right of college students,the following guarantee strategies are proposed: first,to strengthen the education of the rule of law and establish the correct concept of rights by improving the curriculum of education of the law for students and the training of the rule of law for student affairs administrators.Second,to improve the institutional system and provide the basis for the exercise of rights.On the one hand,it provides the legal basis for clarifying the legal identity of students by improving the existing laws and regulations;on the other hand,it improves the rules and regulations system of the school and optimize the mechanism of power distribution within colleges and universities.Third,to strengthen the organizational function and smooth the way of exercising rights by highlighting the "representative" function of the student congress,giving play to the "organizational" function of the student organization and expanding the "judicial" function of the student organization,making the student group can have organizational guarantee in exercising the democratic management rights.Fourth,to grasp the characteristics of The times,enrich the forms of exercising rights,and respond to the special needs of college students’ democratic management right in the Internet era from three aspects: informational construction of democratic management,innovation of student organization mode,and democratic management in the cyberspace. |
