In the process of school management practices in primary and secondary schools in China,many teachers rarely have the opportunity to participate in the democratic management of their schools.As the process of educational governance continues to advance,the issue of the exercise of teachers' democratic management rights has been exposed to people's view,and democratic management rights have become an important topic in scholars' research on teachers' rights.At present,most domestic studies on teachers' democratic management rights are concentrated in the field of colleges and universities,and relatively few studies on teachers' democratic management rights in primary and secondary schools have been conducted,and not much research has been conducted on the protection of teachers' democratic management rights under the rule of law.With the continuous development of educational governance process,how to guarantee the effective exercise of teachers' democratic management rights in primary and secondary schools has become an issue that needs to be studied in depth.Therefore,this study provides an in-depth analysis of the current situation,problems and related causes of the exercise of teachers' democratic management rights in China,and then proposes strategies for safeguarding the rule of law of teachers' democratic management rights in primary and secondary schools.This study is divided into five parts.In the first part,Introduction.The background of the study and the significance of the study are described;the current status of research on teachers' rights and teachers' democratic management rights is reviewed by collecting relevant literature from home and abroad.This study mainly adopts three research methods,including literature method,questionnaire method and interview method.In the second part,the democratic management rights of primary and secondary school teachers and their normative system.By analyzing the connotation of democratic management of primary and secondary school teachers and its jurisprudential basis,it provides relevant theoretical support for further research on the issue of teachers' democratic management rights in China.In the third part,the current situation of the exercise of democratic management rights by primary and secondary school teachers is investigated.In the research design section,we designed a questionnaire and an interview outline on the theme of "teachers' participation in school management" to understand the current situation of teachers' participation in democratic school management in primary and secondary schools,analyze the problems that arise in the process of teachers' exercise of democratic management,and summarize the existing problems.In the fourth part,we analyze the factors that affect the exercise of teachers' democratic management rights in primary and secondary schools.Through the previous investigation of teachers' participation in democratic school management,we found that the main problems in the exercise of teachers' democratic management rights in primary and secondary schools in China are: the legislation on teachers' democratic management rights in primary and secondary schools is not perfect,the path of exercising democratic management rights is not smooth,there are cognitive biases in the relevant educational management bodies toward teachers' democratic management rights in primary and secondary schools,and the relief system and supervision mechanism of democratic management rights are in addition,the remedial system and monitoring mechanism for democratic management are not perfect.In the fifth part,we propose strategies to protect teachers' democratic management rights based on the analysis of problems and causes.The main purpose of this section is to propose strategies for safeguarding the rule of law through five aspects: improving the legal system related to teachers' democratic management rights,facilitating the channels for teachers' participation in democratic management,strengthening the concept of rule of law among education management subjects,and improving the related remedial system and supervision guarantee system.
