Governing the country according to law is China’s basic national policy,and governing the school according to law is an important part of governing the country according to law.The education law of the People’s Republic of China stipulates that the establishment of schools and other educational institutions must have an organizational structure and articles of association,and be managed independently in accordance with the articles of association.Although middle schools in China have established school regulations,there are still some problems in the formulation and implementation of the regulations.Therefore,it is of great practical significance to study the current situation of the construction of school charter and put forward corresponding countermeasures or suggestions.The thesis is divided into five parts.The introduction part starts with a clear meaning,pointing out the background,significance,research review,research content,research methods and innovations of the topic,and focuses on the significance of studying the construction of middle school articles of association;The second part expounds the relevant theories and basic concepts of the research,uses the social contract theory,contingency theory and governance theory as the research theory of this research,and discusses the relevant theoretical issues of the construction of school charter,so as to lay a theoretical foundation for the later stage of research.The third and fourth chapters are the key parts of the thesis and the innovation.The third chapter uses the content analysis method to analyze the text of the school charter of eight middle schools in L District of Y City,category determination,keyword coding and other coding processing,and obtains the problems existing in the formulation of the Charter and the text of the school charter of eight middle schools in L district through formal analysis and content analysis.The fourth part obtains first-hand data through investigation and research,makes statistics and rational analysis of the data,discusses and explains it in the way of a combination of diagrams,tables and words,and obtains the current situation of the constitution construction of eight middle schools in L District of Y City.On the basis of statistical analysis,using social contract theory,contingency theory and governance theory,this thesis analyzes the main problems existing in the constitution construction of eight middle schools in L District of Y City.Through the reason analysis of the problems studied in Chapter 3 and Chapter 4.Finally,the following countermeasures or suggestions are put forward: 1)strengthen the training and education of relevant subjects and improve the awareness of law and articles of Association;2)Improve the ability of leadership and governance and improve the level of running schools according to regulations;3)Build communication platform and supporting mechanism;4)The administrative department of education shall strengthen the guidance of the construction of articles of Association;5)Accelerate the transformation of government functions and establish a diversified supervision mechanism.
