As a new employment mode,labor dispatch is developing rapidly in China and is now widely and massively used in state-owned enterprises and institutions.For state-owned enterprises,labor dispatch can reduce labor costs,reduce labor risks and realize the inflow and outflow of employees of state-owned enterprise.However,while labor dispatch brings convenience to state-owned enterprises,it also brings many problems,and the various contradictions caused by its employment are increasingly intensified.In order to regulate the employment behavior in the labor dispatch market,deal with all kinds of chaos in labor dispatch,China has revised the provisions on labor dispatch in the Labor Contract Law in2012 after the “Labor Contract Law” was promulgated in 2008.Subsequently,the Ministry of Human Resources and Social Security promulgated the "Interim Provisions on Labor Dispatch" in 2014.However,the new labor dispatch policy has not been implemented well in the state-owned enterprises in Leshan City,and many prominent problems that exist in the labor dispatch still have not been solved effectively.The main reason is that the local government in our country has not done enough to supervise labor dispatch of the local state-owned enterprise,and there are loopholes in regulation.From the perspective of local government regulation,this paper uses the literature research method,case analysis method and interview method to carry out research.First,it introduces the basic research status of labor dispatch and government regulation at home and abroad,explains the theoretical basis of labor dispatch and government regulation.Then this paper takes Leshan state-owned K Company as an actual case to analyze the current situation of government regulation in labor dispatch of K Company.It points out that the problems of government supervision in the K Company’s labor dispatch are mainly manifested in four aspects: low frequency of law enforcement inspection and the "tidal" phenomenon in law enforcement inspection,the insufficient implementation of the pre-audit and supervision matters of labor dispatch,lack of cross department joint supervision mechanism,and lack of third-party supervision force.To solve these problems,this paper analyzes the causes and puts forward countermeasures and suggestions to improve the government regulation in labor dispatch of state-owned enterprises in Leshan City.Respectively,we should perfect the supervision standard of labor dispatch policy,improve the administrative supervision ability of local government,encourage the society to play the role of third-party supervision,strengthen the correct guidance to the state-owned enterprises and the dispatched workers in order to standardize the labor dispatch and employment behavior of state-owned enterprises in Leshan City,protect the legal rights and interests of dispatched workers and maintain the harmony and stability of the local labor market. |
