Research On Government Regulation In Labor Dispatch

As a new way of employment,labor dispatch began to sprout when the reform and opening up was implemented and the social market economy was established.With the need of the mechanisms regulating of the labor market,labor dispatch developed rapidly in China.In 2008,regulations in labor dispatch was written in Labor Contract Law of People's Republic of China in our country for the first time.However,the actual effect was not obvious,and the problems were brought out at the same time.Therefore,Chinese government amended the regulations of labor dispatch in Labor Contract Law of People's Republic of China in 2013.In March,2014,in order to standardize the management of labor dispatch,and promote the healthy development of labor dispatch industry,.National Human Resources and Social Security published Provisional Regulations on Labor Dispatch.According to the current situation of China's labor dispatch employment,the author made a summary regarding the volume of labor dispatch,regional distribution,as well as the composition of employees,and further analyzed the background,development process and characteristics of labor dispatch in China.Meanwhile,by taking a large state-owned enterprise in Inner Mongolia Autonomous Region as an example,this thesis elaborated the difficulties in labor dispatch and the standardization of labor dispatch.The thesis made a summary of China's labor dispatch problems exposed in employment by analyzing the present situation of labor dispatch,and concluded that,the law and regulation system construction was lagging behind and it needs to be improved.The administrative licensing and industry admittance has weak constraints and poor supervision.The social security system is not up to expectations.There is still a wide space for the development of labor dispatch in China,and its healthy and sustainable development needs further regulation by the government.With the analysis of China's labor dispatch problems in employment,the last part of the thesis made a discussion on the duties and ways of government regulation on labor dispatch by learning from the relatively mature experience and practice abroad.The thesis also put forward specific methods for government regulation on labor dispatch in the seven aspects:improving the legal system;regulating the labor dispatch application scope;enhancing administrative supervision;accelerating the establishment of a social security system;giving full play to the function of government coordination;encouraging the development of Industry Association and establishing the mechanism of "changing employees from probation to regular workers".
