Research On The Problems And Countermeasures Of Detention Management In District A Of Shenzhen City

Since the reform and opening up,along with social progress and the development of The Times,the structure and trend of Chinese crimes have undergone major changes.The proportion of serious violent crimes has decreased significantly,the proportion of minor crimes has increased and over 80%.However,the detention rate in China is maintained at more than 50% all the year round,and the detention rate in Shenzhen A District is even as high as more than 70%,which does not match the changes in the criminal structure.According to the principle of proportion,only serious criminal suspects can apply the measures of detention,but our detention measures face the trend of arbitrary and universal.At present,the detention management characterized by high detention rate,long detention time and lack of human rights protection is not compatible with the development process of national rule of law and the change of criminal structure,which will lead to waste of social resources,tension of social relations and high probability of recidivism.It increases the confrontation and tension between citizens and the state,which is not conducive to creating a tolerant and harmonious social environment.In order to meet people’s higher expectations for the rule of law and social justice,we have the responsibility to change our ideas,improve our management,and make some progress in reducing detention.Based on this,with the goal of reducing the number of detainees,this paper is committed to studying the problems and solutions of detention management in District A of Shenzhen City.At the same time,there are problems in the detention management of Zone A in Shenzhen,such as excessive detention in detention centers,difficulty in ensuring the physical and mental health of detainees,and a large number of petitions.The reasons for the existence of the problem cover multiple aspects,such as insufficient awareness of safeguarding civil rights;Not following the efficiency orientation,resulting in low work efficiency;Lack of clear applicable standards for detention;Lack of effective alternative measures for detention.Based on the materials collected from the investigation and the experience of foreign detention management,this paper proposes five measures to optimize the existing problems of detention management in District A of Shenzhen.First,we should update our management philosophy,attach importance to citizens’ rights and interests,and constantly improve the conditions of detention places to ensure the basic living standards of the parties involved.Second,innovation management methods,implement decentralized management,and delegate management functions and powers by authorizing non-governmental organizations to manage,authorizing grid members to carry out information management and other ways to solve the problem of lack of alternative detention measures.Third,adhere to the efficiency-oriented,establish a collaborative mechanism,and unify the performance assessment objectives and optimize the working mechanism through the collaborative way,so as to improve the work efficiency and reduce the detention time.Fourth,strengthen the internal regulation,through the establishment of clear detention applicable standards to limit the abuse of detention,reduce the number of detainees.Fifth,unblock the channels for citizens’ participation,fully listen to the opinions of citizens,build a multi-center co-governance management pattern,and establish a perfect relief mechanism,to protect the parties’ right to change detention.
