| With the advancement of our country legal system construction, security supervision work of our country gradually evolved from the closed management of single state to open comprehensive governance. The detention center as the main place of pretrial detention in our country, it is the necessary object of study of criminal justice, the international and scientific concept of its supervision model and regulatory concept will help us the construction of harmonious society and the country’s stable development. Now, As the revised and promulgated the amendments to the criminal law, criminal procedure law and other laws, civilization to safeguard human rights and international safety standards were introduced to our country in the guard regulatory goals actively.But in the short term, the jail constantly exposed to various regulatory shortcomings in our country,this profoundly tells our current detention center management system has been difficult to fit the needs of the existing rule of law, the path of reform is imperative.Moreover, as an important link in the detention center program—detention program,it is also the beginning of us to learn the entire work of guard detention enforcement, the fair and reasonable on custody procedures has a vital role for the whole criminal lawsuit smoothly. The author introduces the method of empirical research in the process of writing this article. On the one hand, to investigate and collect some actual data some of the detention in custody of S city; on the other hand, to interview with part of law enforcement workers in-depth, understanding of the current problems existing in the detention center, at the same time, the institutional causes and the consequences of these problems are analyzed, after that, combing with the help of the literature review to compare and demonstrate the jail custody program domestic and overseas, reflection of the custody defects and deficiencies of detention center in the regulatory system. Eventually, it is important to note that we must be in combination with its national conditions, from the aspects of standardize the running program, improve the level of supervision and protection and so on,propose suggestions and countermeasures to improve legislation of the detention center custody program, in order to dedicate meager strength on the construction that reform of the detention places in our country. |
