Study On The Protection Of Juvenile Victims In Sexual Offences

The protection of minors’ sexual rights has always been a topic of concern for us.The implementation of the protection of underage victims in sexual assault crimes is not only related to the healthy development of underage physical and mental health,but also to social stability.In recent years,there have been frequent cases of sexual assault on minors,and the country has gradually increased its emphasis on the protection of underage victims in sexual assault crimes.Significant progress and achievements have been made in legislation,justice,and society.However,the protection of underage victims in sexual assault crimes in China is still in its early stages,Faced with the increasingly complex and ever-changing forms of sexual assault offenders and various criminal methods,there are still problems in protecting underage victims in sexual assault crimes,and there is still a long way to go to protect underage victims in sexual assault crimes.This article focuses on strengthening the comprehensive protection of underage victims in sexual assault crimes,exploring the current problems in the implementation of legal protection regulations,special protection systems,and social protection for underage victims.At the same time,drawing on the relevant experience of neighboring Japan,targeted countermeasures are proposed.The structure of this article is mainly divided into the following four parts.The first part is to sort out the relevant concepts of underage victims in sexual assault crimes,analyze the scope and characteristics of their injuries,and also point out the current protection status of underage victims in sexual assault crimes in our country.The second part analyzes the current situation and provides targeted analysis of the problems in protecting underage victims in sexual assault crimes in China.The main issues are weak legislative protection in terms of legal protection regulations,lack of a system for compensation for mental damage,gender discrimination in the protection of charges of sexual assault against minors,and incomplete protection of the privacy rights of underage victims.There is a problem of insufficient implementation of the legal aid system and psychological counseling mechanism in the implementation of the special protection system.In terms of social protection,the school’s protection function has not yet been fully fulfilled,and there is a lack of professional teams in social organization protection.The third part is to analyze the relevant experience of our neighboring country Japan in protecting underage victims in sexual assault crimes.Although Japan is relatively free in terms of sexuality,it also places great emphasis on protecting victims of sexual assault crimes.It has valuable experience to learn from in terms of legal protection regulations,implementation of special protection systems,and social protection.The final fourth part is to propose targeted countermeasures based on the above issues and the relevant experience of Japan.By improving the legal protection regulations for underage victims in sexual assault crimes,implementing relevant special protection systems,and optimizing social protection for underage victims,we aim to prevent the occurrence of sexual assault underage crime cases,safeguard the sexual rights and interests of underage victims,and promote the healthy and happy growth of minors.
