Research On The Protection Of Minor Victims In The Crime Of Sexualassault In China

At present,the society pays more attention to the crime of sexual assault,but less attention to the protection of minor victims.Compared with adults,minors suffer serious physical and mental injuries after sexual assault,and need more multi-field,all-round and three-dimensional protection.Although many laws,such as the Criminal Law,the Criminal Procedure Law,and the Law on the Protection of Minors,stipulate the protection measures for minor victims,some areas explore the method of protecting minor victims in the crime of sexual assault,but by analyzing 305 cases of sexual assault on minors collected from China Judgments Online since 2020,sorting out 96 questionnaires of primary and secondary schools and kindergartens in Changzhou,and conducting field research on the protection work of minors by Changzhou Public Security Bureau and Changzhou Economic Zone People’s Procuratorate,it is found that the protection effect of minor victims is still not satisfactory.There are problems such as insufficient legislative protection for male minor victims,inadequate sex education in schools and irresponsible social organizations.It is urgent to further improve the protection path for minor victims in sexual assault.In terms of prior protection,schools can add sex education courses to enhance the self-protection awareness of minors.In terms of protection in the event,the authorities can improve the level of protection of minors.For example,special agency should be set up to coordinate the protection of minors,and a multi-department linkage mechanism should be established.In the aspect of post-event protection,we can explore a comprehensive mode of economic aid,psychological counseling and so on.While strengthening the protection of minor victims,measures such as information disclosure,and early warning of sexual assault criminals can be adopted to regulate the behaviors of offenders and reduce the possibility of minors being harmed.In terms of the protection measures for minor victims,we should base on the protection status quo,explore the expansion of the protection of minors,and maximize the protection of the rights of minors.
