Besides causing harm to minor victims’ health,sexual assault on minors has a negative impact on their families and society,and has therefore attracted much attention.As a result of the nature of sexual assault and the particularities of minor victims,it is common to encounter difficulties during the investigation process,such as the "one-on-one" evidence dilemma between minor victims and criminal suspects,as well as secondary harm due to repeated interviews.Research on interviews is imperative in order to improve the evidentiary effect of the minor victim’s statement and ensure the minor victim’s safety.There are four parts to this paper: the first is an overview of the research.Interviewing minor victims of sexual assault has both theoretical and practical implications.The paper outlines and summarizes relevant research conducted at home and abroad,as well as research methods such as case studies and empirical studies.The second part,based on the legal documents on the crime of sexual assault from Judgment Documents Network,and referring to the research reports of public welfare organizations and government official website data,sorts out the current situation and characteristics of the crime of sexual assault on minors,from the overall characteristics of the crime,victims,and suspects from the four levels of people and criminal behavior,analyzes the characteristics of the crime of sexual assault of minors that are different from other crimes,and gains an in-depth understanding of the crime of sexual assault of minors.In the third part,the difficulty of interrogating minor victims of sexual assault crimes in the investigation work is analyzed from three perspectives: the interview object,the interrogator,and the organization and implementation of the "one-stop" case-handling mechanism.The first is the particularity of the juvenile victim as an interview object in terms of emotion,cognition,and expression ability.As well as influencing the interview work,it influences the gender structure of the interrogators as well as the victim’s cognition of the crime.Insufficient interview skills have affected the effectiveness of interview work;finally,in the process of organizing and implementing the "one-stop" case-handling mechanism,the lack of information sharing and cooperation mechanisms,lagging case-handling mechanisms,and single interview venues have also affected the effectiveness of interview work.The fourth part,aimed at interview work difficulties,puts forward solution strategies from the perspective of interview objects,interrogators and the "one-stop" case-handling mechanism.On the one hand,combined with psychological and linguistic theories,eliminate the influence of negative emotions of minor victims,identify their ability to accept inquiries,and judge the authenticity of their statements;on the other hand,increase the proportion of female interrogators and correct misunderstandings of adult crimes,and improve inquiry procedures and methods.In addition,for the "one-stop" case-handling mechanism,it is proposed to build an efficient informationsharing and cooperation mechanism,a case-handling mechanism led by the cooperation of the prosecutor and the police,and select the place of inquiry based on the principle of protecting minor victims.In summary,the investigation of sexual assault on minors has improved under the guidance of the core concept of protecting minor victims.It is better to obtain objective and true verbal evidence and protect minor victims’ physical and mental health.To achieve a balance,to provide reference and reference for practical work. |
