State-owned enterprises play an important role in the world economic stage,and some developed countries believe that state-owned enterprises have obtained special treatment and unfair competitive advantages far beyond private enterprises based on their state-owned status,including government subsidies,preferential treatment in supervision and management,etc.,so they generally have strong market competitiveness and comprehensive strength.In order to eliminate the special advantages of state-owned enterprises for official reasons,promote the establishment of a market environment for fair competition between state-owned enterprises and private enterprises,and reduce concerns about the distortion of competition by state-owned enterprises,the rules of state-owned enterprises have gradually emerged.Compared with other Free Trade Agreements,the CPTPP state-owned enterprises rules reflect the characteristics of strengthening the rules of competitive neutrality,expanding the scope of enterprises covered by the rules,initiating non-commercial assistance rules and the overall improvement of transparency obligations,and at the same time have brought certain impacts to China,putting forward new requirements,including may lead to a reduction in the difficulty of countervailing duty determination,increase the difficulty of overseas investment of enterprises,and curb the pace of state-owned enterprises going global.At present,China is applying to join the CPTPP,and studying the current situation of the rules of state-owned enterprises of Free Trade Agreements that China has signed,and it is found that the proportion of Free Trade Agreements that incorporate the rules of state-owned enterprises is relatively low,and the level of rule-making is not high.To this end,it is necessary to actively carry out negotiations on new issues for state-owned enterprises and actively participate in the construction of international rules for state-owned enterprises.In response to the negotiation of CPTPP’s high-standard state-owned enterprises rules,China should adhere to the definition of state-owned enterprises that conform to China’s national conditions,consider introducing competition-neutral rules with ownership neutrality as the core,and further promote state-owned enterprises reform and standardize the government’s subsidy model for state-owned enterprises.
