The Report on the Work of the Government of 2023 mentioned that actively promoting the accession to the Comprehensive and Progressive Trans Pacific Partnership Agreement(CPTPP)is the focus of attracting and utilizing foreign capital in the future.The report of the 20 th National Congress of the CPC stressed that China should promote high-level opening up and expand institutional opening.A high-level opening up to the outside world requires China’s economic system to achieve internal and external connectivity with international high standard economic and trade agreements such as the CPTPP in terms of rules,regulations,management,standards,etc.The CPTPP state-owned enterprise rules(The SOE rules)are based on the principle of competition neutrality,aiming to eliminate the public advantage of SOEs and create a fair international market.They are high standard rules specifically formed for SOE entities,breaking through the subsidy rules of the World Trade Organization,posing new challenges for developing countries led by SOEs.2023 is the first year of building Chinese path to modernization,and also an important period for China’s economic recovery after the epidemic.China insists on expanding opening up,promoting the reform of domestic systems and mechanisms,and promoting reform through opening up.Faced with the high standards of the SOE rules,China’s continuous promotion of SOE reform has similarities,but more differences.Therefore,the author conducts research.The paper consists of four chapters.The first chapter introduces the research background and significance,summarizes and states the academic achievements of relevant research both domestically and internationally,identifies the research methods,innovations,and shortcomings of this article.The second chapter is based on the legal provisions of the SOE rules,analyzes the content of the provisions,and compares them with traditional international law,emphasizing the breakthrough of the SOE rules.The main research focuses on the definition of SOEs,non commercial assistance clauses,and other content.The third chapter analyzes China’s rules for SOEs facing CPTPP,which not only include internal barriers to joining CPTPP,but also slightly inferior aspects of domestic SOE reform.Focus on analyzing the main directions and achievements of current SOE reform,and combines the practical contracting content of the EU-China Comprehensive Agreement on Investment to study the gaps in benchmarking the rules of CPTPP.The fourth chapter elaborates on the necessity for China to actively promote the accession process in the future.Taking Vietnam’s reform,contracting as a reference,and combing with the current situation of China’s SOE reform,analyze the lessons learned from future reforms and striving for exceptions.It emphasizes that placing on China’s SOE reform to meet the standards of the CPTPP in the context of national conditions,and adapting rules should not shake the Chinese characteristics.
