Research On The CPTPP State-owned Enterprise Rules

In September 2021,China formally applied for accession to the Comprehensive and Progressive Trans-Pacific Partnership Agreement(hereinafter referred to as the "CPTPP").The CPTPP was initially led by the United States of America.Although the final withdrawal of the United States has some impact,the high-standard rules for state-owned enterprises therein are still very attractive for China’s state-owned enterprises.Therefore,through the introduction of the background and theory of the SOE regulations,the analysis of the main items of the SOE regulations,the influence of the wide application of the SOE regulations to our country.Furthermore,we should,from the current position of our country,put forward countermeasures on reasonably absorbing the rules on state-owned enterprises in the CPTPP,seize the development opportunities,speed up the reform process of state-owned enterprises in our country,and actively face the challenges brought by the transformation trend of high-standard international multilateral trade agreements such as the CPTPP.Great efforts shall be made to comply with the international rules on state-owned enterprises,and the high standard of CPTPP rules on state-owned enterprises shall be realized.In addition to the introduction and conclusion,this thesis is divided into four parts:The first part gives a brief introduction of CPTPP’s SOE Rules.Firstly,it introduces the background and characteristics of CPTPP’s SOE Rules,and then introduces the theoretical origin of SOE Rules,that is,the basic meaning of competition neutrality and its embodiment in international trade agreement.Then it leads to the analysis of the core rules of the SOE chapter of CPTPP.The second part is about the analysis of the core rules of the SOE chapter of CPTPP.It includes the definition of the applicable SOEs and the analysis of the three basic obligations of SOEs: non-discrimination and commercial consideration,non-commercial assistance and transparency.From the perspective of dialectics,this thesis analyzes the characteristics of the core rules of the SOE chapter in CPTPP.The third part first discusses the important status of state-owned enterprises in China and the embodiment of the rules of state-owned enterprises in domestic law in detail.Then,guided by the core rules,it demonstrates the influence of the wide application of the high standard CPTPP rules on state-owned enterprises.This leads to China’s response by reasonably absorbing the CPTPP rules on state-owned enterprises.The fourth part,firstly,according to the above analysis and argument,the possible attitudes of our country towards the CPTPP SOE Rules are summarized,which mainly include three attitudes,namely,acceptance,conditional acceptance and current unacceptable.Then it combines the above analysis,based on China’s current national conditions,from the following three dimensions: formulating a unique negotiation plan based on China’s national conditions,deepening the reform of state-owned enterprises and improving the competition legislation system of China’s state-owned enterprises and proposing countermeasures to effectively absorb the rules on state-owned enterprises in the CPTPP.
