The mode of remote work differs from traditional work,as remote workers are not bound by the physical form of traditional workplaces and instead conduct their work in the virtual space constructed by the Internet.This article summarizes the common characteristics of remote work based on definitions of remote work from scholars in foreign countries and domestic experts,and establishes the basic concept of remote work through these common characteristics.The article also demonstrates the necessity of protecting the labor rights and interests of remote workers.There is a lack of laws,regulations,and judicial interpretations regarding remote work in China,which has resulted in many problems such as unclear recognition,difficulty in determining work hours,and inadequate job security for remote workers.This article analyzes the issues of legal protection of the rights and interests of remote workers from the perspectives of legislation and judicial practice in China,based on analysis of the remote work systems and related research both domestically and internationally.Combining with the actual situation in China,this article proposes suggestions for protecting the rights and interests of remote workers.These suggestions mainly include: improving relevant legislation and judicial interpretations related to remote work;recognizing remote work through mutual agreement between the parties,granting remote work request rights to the workers,and signing written agreements;developing targeted working hours systems from the perspectives of work hours and overtime;establishing remote work environment safety supervision mechanisms,recognizing work-related injuries for remote workers,and expanding the scope of occupational disease protection;and proposing suggestions for the application of remote work in sudden public safety incidents.
