| In recent years,China has gradually entered an aging society.With the development of the times,the comprehensive quality of the elderly groups in China has gradually improved,and its value has become more and more obvious.More and more elderly groups choose to return to employers for re-employment after retirement.Focusing on the current situation of aging population and the demand of labor shortage in China,the research on the protection of labor rights and interests of retired reemployed people is conducive to solving the employment problem in China.Legislation,our country is not perfect,the legal status of retired re-employment groups need to be clear,and the employment relationship between them and employers has not been clear,which makes it difficult to protect the labor rights and interests of retired re-employment personnel.As a global problem,the protection of the rights and interests of retired and reemployed people,developed countries entered the aging society earlier,which has reference value for their labor rights and interests protection system.To construct and perfect the labor rights and interests protection system of retired and re-employed personnel in China,we must first clarify the legal status of retired and re-employed personnel,confirm their laborer status,and define the employment relationship between retired and re-employed personnel and employers as special labor relations,enjoying the inclined protection of labor law;Implement the wage guarantee of the right to equal pay for equal work for retired reemployed personnel,so that their income can be guaranteed;Confirm the way to guarantee the right of industrial injury insurance for retired and reemployed persons,so that they can get relief when they are injured at work;Improve the security system of retirees’ pension insurance rights and separate pension insurance rights from employment rights;Enrich the relief methods for the labor rights and interests of retired and reemployed personnel,and realize multi-way protection of their labor rights and interests. |
