Research On The Revision Of The Yunnan Provincial Product Quality Supervision And Administration Regulation

Product quality,as a hot issue of national focus this year,has received much attention from all sectors of society.Therefore,the supervision of product quality has also become a hot topic of concern and discussion in society and academia.Product quality supervision involves multiple subjects such as government,third-party social organizations,enterprises,and consumers,spanning multiple disciplines.At present,China has entered the New Normal,but there are still some mismatches between the current commodity quality supervision mode and the continuous improvement of people’s demand for commodity quality as well as the reform of the market supervision system.This article takes Yunnan Province as an example and aims to explore the legal issues in the future revision of the "Yunnan Province Product Quality Supervision and Management Regulations".By using experience and comparison methods,it systematically analyzes the reference points and problems of the product quality management regulations in Yunnan Province,other provinces,and at different levels across the country,On this basis,suggestions are put forward to improve the "Regulations on Product Quality Supervision and Management in Yunnan Province",which will help Yunnan Province to refer to in future revisions.The introduction section mainly elaborates on the background and significance of the topic,as well as the current status of relevant research,as well as the research ideas,methods,and innovations of this article.The main body of this article consists of four parts:The first part first briefly elaborates on the historical evolution of the revision of the Regulations on Product Quality Supervision and Management in Yunnan Province.Secondly,it summarizes the problems existing in the regulations and analyzes and explores them one by one.Finally,it clarifies the necessity of initiating the legislative revision of the Regulations on Product Quality Supervision and Management in Yunnan Province.The second part first clarifies the significance and feasibility of horizontal comparative research in revising relevant regulations in Yunnan Province.Also analyze the areas that Yunnan Province can learn from in recent years when revising product quality supervision regulations in other provinces,and point out the potential problems that may still exist after the revision.The third part is to study and research the "Product Quality Law of the People’s Republic of China(Revised Draft for Soliciting Opinions)",read each chapter’s revised changes one by one,and analyze the future development trend of national regulations on product quality,and extract the experience and innovation that are worth learning from the "Yunnan Province Product Quality Supervision and Management Regulations".The fourth part is to analyze and explore the "Interim Measures for the Management of Product Quality Supervision and Random Inspection",extract several principled measures that are clearly defined in terms of product quality supervision and random inspection,so that Yunnan Province can grasp the principled issues when implementing relevant regulations.At the same time,it also explores the possible problems that may arise in the practical application of the Interim Measures for Supervision and Random Inspection,In order to study the existing problems and develop solutions when formulating relevant regulations in Yunnan Province.The fifth part is based on the analysis and research of the previous regulations,proposing revision suggestions for the "Regulations on Product Quality Supervision and Management in Yunnan Province".Firstly,it is a macro reflection on improving the relevant regulations in Yunnan Province from four aspects: legislative purpose,scope of application,law enforcement departments,legislative authority,and legislative interpretation power;Secondly,specific revision suggestions are proposed for the current regulations.
