Product quality is one of the core indicators of economic and cultural fields,in the process of rapid economic development in recent years in our country gradually get more and more attention to the parties,with the relevant laws and regulations for the quality of the research also more and more hot.In terms of product quality supervision and legal system,the current foreign related theory system has been basically mature,writings,such as the government regulation theory,and the theory of law and economics theory,represented by their comprehensive reasonable should strengthen the supervision over the quality of product is expounded the rationality and operability.But from the point of view of the domestic situation is not optimistic,the current product quality supervision system in the implementation of legislation and system there exist some problems,such as quality inspection in the process of spot check,defect product recall,the issue of legal problem,repeated examination questions and so on.So from the overall,our country product quality supervision and inspection system is not perfect,still need to further improve and correction.The author believed that the developed countries and regions have already formed a relatively perfect legal system of product quality supervision for the perfection of legal system of product quality supervision in China has important significance;For legal system of our country product quality supervision and the existing prominent problems,and combining the successful experience abroad,the author argues that should have three aspects need to further improve: first is should improve the product quality supervision legal system.From the legislative value of the product quality supervision and the legal system for a correction,product quality supervision law should not only accord with the value concept of administrative law,but also corresponding to the value of economic law goal,for the special problems in the necessary circumstances can carry out special supervision;Second innovation should be made for specific supervision system,especially glaring defect product recall system of problem and improvement of the system of product quality supervision and spot check,etc.Finally,is administered in law enforcement procedure for leak fill a vacancy,to further standard procedure to check the quality of product,avoid arbitrary,arbitrary examination,at the same time clear the product quality supervision and inspection of tort law relief channel,as well as necessary to carry out quality inspection departments of administrative inspection a draw,avoid excessive exercise of power.
