Research On The Mechanism Of Police Participation In Civil Mediation

In order to achieve the great goal of building a harmonious society as soon as possible,the State has established the idea of "Great Mediation" for the comprehensive management of social disputes,and the construction of a collaborative management of social conflicts and disputes has become an inevitable development trend.The social mediation function of existing dispute mediation organizations is weakening,and they are no longer able to fully meet the mediation needs of the public.The new norm is that the public security organs have gradually become the main force involved in civil mediation.However,there is currently a controversy in the theoretical circles as to whether the police should participate in mediation of civil disputes and whether the act should be defined as a police activity,and a more perfect mechanism for police participation in civil mediation has not yet been formed.The police’s participation in civil mediation is a source of governance.Police participation in civil mediation is one of the important ways of governance of the source of litigation,is a front-line issue of litigation law,in law enforcement practice by the people’s favor,has a strong vitality.Police participation in civil dispute mediation compared to people’s mediation,court mediation has direct and efficient,convenient procedures,low cost,strong authority and other advantages,give full play to its advantages,so that it has become a long-term mechanism to alleviate the pressure of litigation,maintain social stability,etc.has outstanding practical significance.Based on the practice of public security law enforcement,this paper analyzes the legitimacy of police participation in civil mediation in terms of legal basis,realistic needs,comparative advantages and practical effects,and obtains data on police participation in civil mediation cases from three representative urban police stations and two township police stations of the Z City Public Security Bureau in S Province in the past three years through visits and research.The study also explores the relationship between police participation in civil mediation and judicial pre-litigation mediation,with a view to improving the relationship between litigation and mediation.The relationship between police participation in civil mediation and judicial pre-litigation mediation,with a view to improving the docking of mediation,promoting the governance of the source of litigation,enhancing the quality and effectiveness of social governance,and ensuring that public security organs play their due value in the collaborative governance of conflicts and disputes.
