Research On The Optimization Of The Docking Mode Of Litigation And Mediation In Grassroots Contradictions And Disputes

With the development of economy and society,the consciousness of rights is deeply rooted in people’s hearts.More and more parties choose to solve their disputes through litigation,and the contradiction between the number of court cases and the number of people is becoming increasingly prominent.In order to find a way out of the current judicial dilemma,the docking of litigation and mediation was born.In 2022,county-level social governance centers that integrate multiple functions,such as petitioning,handling conflicts and disputes,handling social governance incidents,analyzing and judging social risks,and major emergency management,will be effective,becoming an important carrier for the reform of "no more than one place" in the field of social governance,and creating opportunities for the breakthrough development of litigation and coordination of conflicts and disputes at the grassroots level.This paper tries to use the case study method and the field investigation method to study the conflict and dispute litigation and adjustment docking mode of the social governance center at the county level in Y City,summarize the problems existing in the grassroots conflict and dispute litigation and adjustment docking work in Y City,and put forward suggestions and countermeasures by combining theory with practice,so as to make the conclusions more authentic,operable and referential.In order to further promote the grassroots conflict disputes litigation and mediation docking mode optimization to provide theoretical and practical dual soil.Starting from the core concepts of grassroots contradictions and disputes,litigation and mediation docking,social governance center,and based on theories of collaborative governance and process reengineering,this paper studies the practice of promoting grassroots contradictions and disputes litigation and mediation docking in Y City.Based on the author’s research records in the social governance center of Y City and county level,the author points out the existing problems in the current litigation and mediation mode of grassroots conflicts and disputes,such as the lack of multi-subject coordination,the lack of mediation power and ability,the lack of effectiveness of digital reform,and the lack of endogenous driving force.The main causes of the problem are not close communication and coordination,ability requirements do not meet,the system structure is not perfect,incentives and constraints are not scientific.Finally,according to the problems and reasons,suggestions are put forward from five aspects,including improving the working concept and target positioning,perfecting the litigation mediation connection mechanism,strengthening the mediation talent team construction,breaking the information barrier with digital empowerment,and improving the post goal responsibility assessment.
