| With the advent of the era of big data,data has become a fundamental strategic resource for various countries.The rapid development of advanced information technologies such as the mobile internet and 5G has made cross-border transmission of personal information easy,inevitably bringing unprecedented challenges and risks to the global information order.Developing the digital economy and ensuring the freedom and security of cross-border transmission of personal information is both a global challenge to digital governance and a core proposition of national data legislation.Internationally,the European Union,the United States,and Russia have taken strict,open,and conservative regulatory strategies for cross-border transmission of personal information,with different regulatory effects.China started legislative activities related to cross-border transmission of information relatively late,and we can learn from advanced international experience to improve our legal system for cross-border transmission of personal information.This article is divided into four parts.Chapter 1 analyzes the relevant concepts of cross-border transmission of personal information,defines basic concepts that are consistent with the nature of the legal discipline and suitable for comparative research,and analyzes the risks and challenges posed by cross-border transmission of personal information.The second chapter summarizes the legislative achievements and shortcomings of China by analyzing the relevant rules on the cross-border transmission of personal information at the current legislative level,and selects key perspectives for comparative studies of typical international regulatory models.Chapter III conducts a comparative study using typical models of cross-border personal information transmission rules in the EU,the United States,and Russia as examples,and summarizes the differences in the value strategies,regulatory models,and regulatory systems of cross-border personal information transmission rules in the EU,the United States,Russia,and China.The fourth chapter combines the objective needs of our country,providing a feasible path to improve the regulation of cross-border transmission of personal information in China from aspects such as improving the legal regulation system,refining supporting rules and methods,optimizing the national regulatory organization system,and actively conducting international cooperation. |
