Research On The Legai Regulation Of Cross-border Flow Of Personal Information In China

With the vigorous development of the digital economy,emerging concepts such as the metacom,artificial intelligence and blockchain have emerged.As the core engine for the in-depth development of the digital economy,data is constantly contributing to the healthy development of the economy and society.As the world’s second largest economy,China has become an important builder,leader and contributor to the development of the global digital economy,and cross-border data flow rules have become an important topic of current discussions.At present,we have adopted the Law on the Protection of Personal Information,and constructed the regulation on the cross-border flow of personal information at the legislative level.However,the specific judicial practice is different from the goal pursued by the legislative purpose.In this context,how to effectively balance the relationship between information security,personal information protection and the development of digital industry is the focus of the author’s discussion.This paper mainly studies the legal regulation of cross-border flow of personal information from four chapters.The first chapter is a theoretical analysis of the concept of cross-border flow of personal information,and expounds the necessity of legal regulation of cross-border flow of personal information,and the basic issues of legal regulation of cross-border flow of personal information explicitly discussed.The second chapter discusses the current situation of legal regulation of cross-border flow of personal information,and summarizes the existing problems in legal regulation of cross-border flow of personal information.The third chapter analyzes the regulation mode of the cross-border flow of personal information in the European Union and the United States to provide ideas for the improvement of the legal regulation of cross-border flow of personal information.Chapter four discusses how to perfect the legal regulation of cross-border flow of personal information.Improve relevant laws and refine specification requirements;Improve the supervision mechanism for cross-border flow of personal information;Actively participate in global information governance.By analyzing the current status of legal regulation of cross-border flow of personal information in China,and combining the legal regulation model of cross-border flow of personal information in foreign countries,it is of research value to improve the legal regulation of cross-border flow of personal information in China.
