Research On The Standardization Of Police Administrative Assistance

As a special form of administrative assistance,police administrative assistance has become more and more important in the context of comprehensively promoting the rule of law and reforming the administrative system.However,the current standardized research on police administrative assistance is still relatively weak,and phenomena such as abuse of the right to request assistance from public security organs and inaction by public security organs still occur from time to time.Therefore,it is of practical significance to regulate the administrative assistance activities of public security organs to ensure their legal and scientific development.In the process of studying the standardization of police administrative assistance,the meaning of the word "standardization" is broad,including the standardization of the content,procedure,and execution methods of police administrative assistance.Among them,the police administrative assistance procedure is the core of the standardization of administrative assistance,and the system is used to standardize and guide the assistance behavior.This article starts with the concept of police administrative assistance and its standardized definition,first systematically expounds the concept,nature,and characteristics of police administrative assistance,and through classification and comparison of similar concepts,it comprehensively examines the connotation of police assistance and clarifies the meaning of police assistance.On the basis of the basic attributes,the concept of standardization of police administrative assistance is put forward,that is,the establishment of powers according to law,efficient and orderly operation,full protection of rights and a moderate balance of interests.Then,from the two dimensions of legitimacy and necessity,it discusses the internal logic and theoretical basis of the standardization of police administrative assistance,power restriction and rights protection,separation and integration of administrative functions,the development and evolution of police power,guarantee and restriction,and the regulation of police power.The reality of law enforcement and the concept of social risk prevention all provide theoretical and practical support for the standardization of police administrative assistance.Then collect and organize the laws and regulations related to the assistance of public security organs,and analyze the current practice of administrative assistance by public security organs,and analyze it from four perspectives: the administrative system,the natural expansion of police power,the lack of standardized systems and procedures,and the unsound supervision mechanism.,to clarify the reasons for its failure.Finally,the way to realize the standardization of police administrative assistance in our country is put forward,including the establishment of the principles of police administrative assistance: statutory authority,auxiliary,legal procedures,principles of appropriate assistance and power supervision;clear and standardized "starting" conditions and specific circumstances for requesting assistance;perfecting the police The procedural regulation and responsibility supervision of administrative assistance systematically and comprehensively standardize the administrative assistance of public security organs,in order to benefit the standardization of police administrative assistance at the theoretical and practical levels.
