Research On The Standardization Of Police Administrative Assistance

With the continuous progress of the rule of law in construction of new era Chinese characteristics socialism,and the construction of the national governance system and modernization of governance capacity,the role of administration according to law is becoming increasingly prominent at maintaining social order,promoting economic and social development and protecting citizens’ rights and interests.In our country,the police executive power is an important part of the administrative power system.For a long time,China’s police administrative power has covered every aspect of social life.At present,it is in the period of social transformation with lots of social contradictions,police administrative assistance(hereinafter referred to as PAA)is required in every administrative area.However,due to the abuse of individual PAA rights,the phenomenon of police misconduct gradually spread and worsened.In order to meet the needs of social and economic stability development,it is necessary to standardize PAA activities.This article focuses on the issue of PAA,and tries to find a way to standardize it.The first chapter of this article studies on the basic concept of the PAA.Through the concept and classification of the administrative assistance,defines the concept of the PAA.That is,because of the inability to perform their duties,the administrative organs which is no affiliation with police organs that request assistance from the police authorities on the basis of public interests.PAA has the characters of legality,independence,helper,coercive and modesty.The second chapter makes an empirical study on police administrative assistance.The paper uses the method of empirical analysis to examine the two aspects of legislative system and practical operation respectively.In legislation,our country lacks special laws and regulations for administrative assistance,the obligation norms of PAA spreads in various parts of the law,which causes the implement of the assistance.In practice,PAA is prone to abuse police power and slack off.The reasons include ideology,system power and legislation.And the legislation is root cause.The third chapter gives the construction direction of PAA,what is standardization.By the using of normative analysis and value judgment,expounds the concept of PAA standardization from the misconduct side,and proposes that is the fundamental to deal with the maladies.The standardization of PAA is necessary and reasonable.The last chapter is concrete construction of standardization of PAA.It requires the following of principles of legality,due process and efficiency.It should be constructed on the subject,object,attribution and procedure,clear powers and obligations.And it gives feasible suggestions from supervision system and financial security.
