| Online game live streaming is an emerging modern service industry that spreads through information networks as a medium.It not only promotes the dissemination of online games,but also promotes the vigorous development of the Chinese online game market.In recent years,the rapid development of online game live streaming worldwide has attracted widespread attention.The rapid development of the industry is inevitably accompanied by some issues.Regarding the copyright protection issues related to online game live streaming images,there are divergent opinions and controversies in the academic community.Although the newly revised Copyright Law has officially come into effect,there is still no consensus on the copyright issues involved in online game live streaming.There are disagreements between the theoretical and practical communities,making it difficult to reach a consensus on this issue.Therefore,the main research content of this article is to analyze the problems that arise in the copyright protection of online game live streaming images and explore relevant countermeasures.This article takes the copyright infringement of online game live streaming images as the starting point for research.Firstly,in the introduction section,the background and significance of the topic selection,research status,research methods,and innovative research points are introduced.Secondly,in the second part,the definition,related concepts,and types of online game live streaming screens were introduced.The third part focuses on four issues that often arise in judicial practice through the analysis and research of three classic domestic cases,including whether the live video game pictures can obtain copyright protection,whether the live video game pictures constitute fair use of copyright,whether the compensation standard for live video game pictures is reasonable,and the conflict between copyright law and anti unfair competition law in judicial practice.The fourth part focuses on analyzing the measures taken by foreign countries such as the United States,Japan,South Korea,etc.in terms of copyright protection for online game live streaming,and summarizes some useful practices that can be used for reference in China.Finally,in the fifth part,this article focuses on how to protect the copyright of online game live streaming images in China.Starting from the perspective of the new Copyright Law,it clarifies the nature and types of works in online game live streaming images.At the same time,it improves the nature,reasonable use,and legal application of online game live streaming works from legislative and judicial perspectives,in order to better promote the development of the industry. |
