Copyright Registration System Of China

In 2020,the Copyright Law of the People’s Republic of China was amended.In this amendment,Article 12 was added with content that " Authors and other copyright holders can register their works with the registration agencies identified by the national copyright authorities.” This is the first time that China’s copyright registration system was clarified in high-level laws.However,copyright registration system of China still has a long way to go.Prior to this,legislation on the registration system of copyright was not sufficient,and the system itself lacked comprehensive and systematic legal norms to support it.At the same time,the operating mechanism of the system was not clearly stipulated by the law,which led to some other practical problems of the registration of copyright of China.From the perspective of nature,the legal effect of copyright registration system has not been clarified,and what kind of legal effect registration will produce is still a major question for the right holders of registration.Judging from the operation of the system,the institutional setup for the registration of copyright works in China is still chaotic,the registration procedures are not clear,and there are differences in the content that should be registered.These problems hinder copyright registration system from further providing institutional support and guaranteeing for the protection of copyright.To some extent,copyrights are in a state of lack of protection.For this reason,the author seeks measures and ideas for optimizing the registration system of copyright works in China by studying different academic works on the registration system of copyright works at home and abroad,summarizing their different views.In view of the fact that its legal effect is unclear,the author seeks a registration effect model suitable for national conditions of China by demonstrating the necessity of clarifying the legal effect of copyright works registration,and by combining the relevant experience of foreign legal systems.Aiming at the problem of institutional setup confusion,the author puts forward a unified two-tier management mechanism for the registration of copyright works based on the experience of relevant institutional setup in foreign countries.Aiming at the ambiguity of the registration content and registration procedures,the author sorts out the existing legislation and combines other scholars’ relevant views,and believes that the registration procedures and contents should be regulated separately and systematically.Compared with the protection of intellectual property rights in several developed countries outside the region,China’s copyright registration system is still not perfect and incomplete.For this reason,the author hopes to take advantage of the completion of the third revision of the Copyright Law of the People’s Republic of China and the major changes in the registration system of copyrighted works,with the help of research results on relevant systems at home and abroad and the advantages of foreign systems,combined with the actual situation in the field of intellectual property rights in China,to further analyze the development ideas of China’s copyright works registration system and to put forward ideas for the further development and improvement of the copyright registration system.
